John Moore, alias Mike Sadus, 35, of Anderson Ind. charged with the slaying of Mrs. Mildred Humphrey, 30, Negro, 326 Central av. Newport, is to go on trial Monday before a jury in Campbell Circuit Court. Lawrence J Diskin, commonwealth attorney and Daniel W Davies, attorney, will ask for the death penalty.

Moore is alleged to have shot and killed the Negro on Nov 12, 1930 during a holdup in the victim's home. The accused and James Jacks, Los Angeles, are alleged to have attempted to rob the woman and several other Negro companions. During the progress of the robbery a Negro seized Moore's gun and one shot was fired. It struck the woman.

The accused is represented by Leonard Tiechmoeller, attorney and he expects to show that Moore and Jacks entered the Negro's home to purchase liquor and that they were attacked by several Negroes and the weapon held by Moore, was discharged during the scuffle.
