Court Minutes of February 1, 1796

Page 30-At a Court begun & held for Campbell County at the House of Jacob Fowler on Monday the lst February 1796.

John Bush, Henry Brasher, John Hall, James Miller Junr., John Bartle, Squire Grant & John Ewing esqrs. produced a Commission of the peace from his Excellency Isaac Shelby Esqr. Governor of this Commonwealth appointing them Justices of the peace for this County. Whereupon they were duly qualified & took their Seats upon the Bench.

An Indenture of Mortgage between John Hunt of the one part & John P. Duvall of the other part was produced in Court with a Certificate of the Clerk of Bourbon County of its having been recorded in his office & ordered to be recorded.

An Inventory & appraisement of the Estate of William Cloud deceased was produced in Court & ordered to be recorded.

A Deed from Alexander McConnel to Alexander Woodrow was produced in Court & proved by the Oaths of Alexander Mahan & John Henderson Witnesses thereto & ordered to be certified.

John Bush is appointed Keeper of a public Ferry from his Land nearly opposite North Bend to the opposite shore he having with John Hall his Security entered into & acknowledged Bond according to Law.

Philip Conner is appointed Constable in this County & took the Oath of a Constable & the several Oaths directed by Law.

A Deed from the Trustees of the Town of Falmouth to William Clark was produced in Court certified by two Justices & ordered to be recorded.  Another Deed from the same Trustees to the same certified by two Justices & ordered to be recorded.

The Persons appointed to lay off the Road from North Bend to Reeds made their Report in these words:
 "Agreeable to an order of the Court of Campbell County we the Viewers appointed by the said Court being first sworn have proceeded to view & mark out the Road from North Bend to Reeds on the Licking trace & find that a very good Road may be had, beginning at the River one Rood above a Line dividing the Lands of John Bush & Cave Johnson opposite North Bend & running on Bush's Land along the line to the back side of Bush's field from thence to the point of the ridge above the first Creek & up the Ridge & thence along the Ridge Symm's/Lymm's Blazes leaving Marklands improvement to the left hand & keeping said Blazes about 12 Miles to a Ridge that leads to the old Licking Trace & along said Trace to Reed's."
Given under our Hands this 30th Jany 1796 - Benjamin Craig, George Corn, Richard Markland, Thomas Markland

On consideration where of it is Ordered that the said Road be established agreeable to the Report that John Jones Senr act as Overseer of the same and that the hands on Garrison Run & up the River including Captain Craigs Farm do attend the said Overseer in opening the same for a Waggon Road.

Joseph Smith is added to the Viewers formerly appointed to view a Road from Tanners Station to Newport.

The Court fixed the following rates for the ferry's from the County of Campbell to the North West Banks of the Ohio:
For Man & Horse 9d each
Carriages per wheel 9d
Cattle per head 9d
Small Stock per head 2
d

And The Rates of ferriage across Mouth of Licking the same that are allowed to John Roberts.

Joseph Robinson, James Williams, William Smith and William DeCoursy or any three of them are appointed Viewers to mark out the nearest and best way from Thomas Kennedys Ferry to DeCoursys Run on a direction to Wilmington and to make report to the Court.

Jesse Bracking, John Boyd, Thomas Johnston & Bartholomew Riggs are appointed Viewers from the said Coursys Run to Wilmington.

The above named Justices of the peace to wit John Roberts, James Little, Thomas Kennedy, Samuel Bryant, John Bush, Henry Brasher, John Hall, James Miller, Squire Grant & John Ewing Esqrs being a majority of the Justices of this County proceeded according to Law to fix upon a place for holding Courts in this County & then ballots being examined it was found that the Votes were as follows: 5 for Newport; 4 for Wilmington & 1 for the most central & eligible place.

Joseph Boyd, John Kelgore & Jesse Bracken are appointed Viewers to mark out the nearest & best way from Wilmington to the forks of Grassy Creek.

On motion of Nathan Kelly, William Riddick is appointed his Deputy & the said William thereupon qualified according to law.

Ordered that Court be adjourned 'till to morrow morning 9 on the Clock. Signed John Roberts
