At a Court held for Campbell County on Monday the lst August 1796 at the house of Jacob Fouler in the Town of Newport.

A certificate from Squire Grant certifying the qualifications of John Bartle as a Justice of the peace for this County was produced & ordered to be recorded.

Page 49-Jacob Burnet is admitted an Attorney of this Court he being duly qualified according to Law. Ordered that John Grant, Charles Daniel Senr & Squire Grant are appointed Commissioners to make a division of 4000 and odd Acres lying nearly opposite to Wilmington between William Kennedy and Alexander Dudgin the said Dudgin being a Non Resident & return their proceedings to the next Court.

Present John Bartle Esquire; On the Motion of Mary Perry who made Oath according to Law & together with Nathan Kelly her Security entered into and acknowledged Bond in the penalty of four hundred pounds conditioned as the Law directs Certificate is granted to her for obtaining Letters of Administration on the Estate of Samuel Perry in due form.

Ordered that Washington Berry, Thomas Lindsay, William Dodds and Jacob Mills or any three of them being first Sworn before a Justice of this County do appraise in current Money the Slaves (if any) & personal Estate of the aforesaid Samuel Perry decd & return the appraisement to the next Court.

Page 50-James Little, John Arnold & Archibald H. Reed or any two of them are appointed Commissioners to establish the beginning of an Entry made in the name of John Gay beginning on the North fork of Eagle Creek at a White Oak Tree marked AMC for 5380 Acres and to take the Deposition of Such Witnesses as shall be produced for establishing the same.

Elizabeth Benham Widow of Peter Benham, deceased appears and declares that she will not take or accept the provision made for her by the Will of the said Peter or any part thereof & renounces all benefit which she might claim by said Will and demands thereupon her legal provision according to the Statute.

An Inventory and Appraisement of the Estate of Peter Benham dec'd was presented in Court and ordered to be recorded. Present Henry Brasher Esquire

On the Petition of Robert Todd by Henry Pickels his Attorney in fact he is appointed Keeper of the public Ferry from his Lands where Henry Pickles now lives across the Ohio to the opposite Shore and it is Ordered that he be allowed the same fare as other keepers of public ferries are allowed in this County & it is furthermore Ordered that he constantly keep two good and sufficient Boats one for transporting Horses & the other fer (sic) foot passengers with four good hands to attend the same and thereupon the said Robert Todd with Henry Pickles his Security entered into & acknowledged Bond according to Law.

On the Motion of Jacob Foster it is ordered that the Sheriff at the Costs and Charges of the said Jacob summon a Jury of Freeholder of the Vicinage to meet upon the Lands on the 25th inst who being met and duly sworn shall diligently view & examine the said Land and the Lands adjacent thereto on both sides of the Run which may be affected or laid under Water by building such Mill together with the Timber & other conveniences thereon and make true report of all things necessary in manner & form as is directed by the Writ of ad quod damnum to the said Sheriff hereby ordered to be issue to the next Court.

On the Motion of John Ewing for leave to build a Water Grist and Saw Mills on forklick Creek he owning the Lands on the South Side of said Creek It is ordered that the Sheriff at the Costs of the said John proceed according to the directions of a Writ of ad quod dannum to be issued out of this Court for the purpose of ascertaining according to law whether the motion of the said John ought to be granted & that he return the said Writ & his actings thereon to the next Court.

Page 52-On the Motion of William Downard ordered that a Writ of quod damnurr be issued to the Sheriff according to Law returnable to the next Court to ascertain (at the costs of the said William) whether he shall have leave to build a Water Grist Mill on Blanket Creek he owning the Lands on both sides of said Creek.

On the Motion of William DeCoursey Ordered that a Writ of ad quod damnum to be executed on the 24th Ins't be issued according to Law returnable to next Court to ascertain (at the Costs of the said William) whether he shall have leave to build a Water Grist Mill on DeCourseys Creek he owning the land on both sides of the said Creek.

The Persons appointed to lay off the road from Falmouth to the broad ford reported that they had laid off the same as follows; beginning at Falmouth thence along Birds old Trace to Congers (? Cougers) Plantation thence to Jacob Deringers Plantation thence to John Sharps Plantation on Blanket Creek thence crossing said Creek at the Forks thence along a ridge by the Marks into Downards Road thence along that Road to Andrew Vances thence by the Marks to intersect the road leading from Harrison Court house to Falmouth at the County line. In consideration where of it is Ordered that the said Road be established according to the said Report as a Waggon Road that Arthur Burns act as Overseer of the same and that all the Male labouring Titheables within the forks of Licking and on the North side of Main Licking within Two Miles do attend the said Overseer in cutting out the same & in the Keeping it in good repair whenever required.

William Daniel Commissioner of this County having produced an Account to the Court for services done amounting to 57-1/3 Dollars Ordered that the same be certified.

On the Motion of William DeCoursey he is authorized to Keep a public Ferry from his Land across Licking to the opposite shore & it is ordered that he be allowed the established rates of ferriage and thereupon the said William with John Bartle his Security entered into & acknowledged Bond according to Law.

On the Motion of Ellison Williams It is Ordered that a License be granted him to keep a Tavern in this County for one year the Said Ellison having with Jacob Foster his Security entered into and acknowledged bond according to Law.

On the Motion of Michael Brady It is Ordered that a License be granted to him to keep a Tavern in this County for one year he having with Henry Pickle his Security entered into and acknowledged Bond according to Law.

On the Motion of William Crane It is ordered that a License be granted to him to keep a Tavern in this County for one year he having with Reuben Lummas his Security entered into & acknowledged Bond according to Law.

On the Motion of Nicholas Egbert It is ordered that a License be granted him to keep a Tavern in this County for one year he having with William Smith his Security entered into and acknowledged Bond according to Law.

On the motion of Jacob Fowler It is ordered that a License be granted to him to Keep a Tavern in this County for one year he having with Nathan Kelly his Security entered into and acknowledged Bond according to Law.

On -the motion of Thomas Scott It is ordered that a License be granted to him to Keep a Tavern in this County for one year he having with Charles Morgan his Security entered into and acknowledged Bond according to Law.

Page 55-Ordered that Charles Morgan Jonathan Ross & Jacob Fowler be added to the Viewers appointed to mark out the Road from Newport to DeCourcys Run on a Direction to Wilmington & make their Report to the next Court.

The Persons appointed to view and mark out a Road from the Widow Stevens's to the County line on a direction to Washington report that the Said Road marked out by them runs as follows from Mrs. Stevens' to Strike Wells' Creek at the old ford thence up the Creek to the head thence crossing the waters of Stepstone to the foot of the Dry Ridge thence along the said Ridge to the County line  on consideration whereof it is Ordered that the said Road be established according to the said Report as a Bridle way that James Miller act as Overseer of the same and that the Male labouring Titheables on the said Road Do attend the said Overseer in cutting out the same when call'd on and likewise for Keeping the same in good repair.

The last Will and Testament of Hugh Swan deceased was proved in Court by the Oaths of William Riddick Thomas Riddick & John Brasher Witnesses thereto and Ordered to be recorded.

On the motion of Jacob Barrickman one of the Executors named in the last will and testament of the aforesaid Hugh Swan deceased who made Oath there to and together with William Riddick his Security entered into and acknowledged their Bond in the penalty of one hundred pounds conditioned as the law directs Certificate is granted to him for obtaining a probat thereof in due form.

Ordered that John Brasher Robert Craig & William Anderson being first sworn before a Justice of the County do appraise in current Money the Slaves if any & personal Estate of the aforesaid Hugh Swan deceased and return the Appraisement to the next Court.

Ordered that William Smith, Presley Peak, Asa Peak, John Loren and Joseph Robinson or any 3 of them being first duly sworn do mark out the nearest and best way from Henry Pickles to intersect the George Town Road so as not to pass through any plantation & make report thereof & of the conveniences & inconveniences of said Road to the next Court.

Page 57-Ordered that the Sheriff pay to James Taylor L23-8-4 for Record Books furnished this County L9-l6 of which was allowed by the Court of Quarter Session for Books for that Court and that he pay the same out of the Depositum of 1795.

Ordered that William Daniels resignation of the office of Constable be accepted.

An Inventory and appraisement of the Estate of David Leitch dec'd was presented in Court and Ordered to be recorded.

An Indenture of Bargain and Sale from John Bartle of the one part to Hugh Swan of the other part for an Out Lot in the Town of Newport was acknowledged by the said John & Ordered to be recorded.

Ordered that the Sheriff be allowed 12/ out of the Depositum of 1795 for a Ballot box and Lock furnished this County.

At the request of Mary Chambers she has taken an Oath that her daughter Sarah living with Daniel Thatcher is an Infant which is ordered to be certified.
