Charged with shooting to kill his brother, Owen, John Finnegan was held to the grand jury Thursday in Newport, by Police Judge Moore, after hearing the testimony. The accused told the story of self-defense as given in the Post Tuesday.

His mother, however, testified Owen did not have a knife, but was rolling a cigarette at the time of the shooting. Her testimony favored the son who lives with her and who was shot. Judge Moore, after hearing the testimony, decided to turn the case over to the grand jury and fixed the bail at $400. Finnegan fired five shots, three taking effect; but none is dangerous now. The affair happened on West Fifth av. Sunday.
