Fined For City In Damage Suit

 

A jury in the Campbell co. Circuit Court yesterday returned a verdict for the City of Newport in the suit brought by John Schwertzer to receive $170 for injuries to a horse.  It was alleged by the plaintiff that owing to the faulty construction of an iron track drain at Eleventh and Columbia Sts., his horse caught the calks of its shoe in the plate, lifted it up and one of its legs went into the hole. 

Solicitor Bakr (?) for the city contended that the track drain was of accepted style and that there was no negligence on the part of the city.
