343 The State of Ohio, Jefferson County, ss Court of Common Pleas The Last Will & Testament of Nicholas France: (Transcribed from photocopy - E Jeter 3/9/2002) In the name of god amen I Nicholas France of Jefferson County State of Ohio calling to minde the mortality of the body but sound in mind, memory, and understanding Resolving all do constitute this to be my last will and testament in manner and form following, to witt, after my just debts and funeral expenses are paid, the rest of my Estate real and personal that hath please God to bestow on me, first I give and bequeath to my Grandson John France, son of Jacob France deceased one hundred acres of land after my death and the death of my beloved wife Margaret France it being a parte of Lot Nš 1 Eleventh Township, Fourth Range, including all the improvements where I now live to be bounded with the land I sold to my sons, Peter France and Samuel Underwood as far as to include one hundred acres, also two houses, plough, Waggons and gears together with all my farming Essentials that I am now in possession of provided the aforesaid Margarett my wife after my deceased Shall have a reasonable Maintainance of the Land devised to my Grandson John France. Likewise the aforesaid grand[son] not to enjoy a full possessions of the above until he arrives at full age according to Law then to be his forever according as above. Item. I give and bequeath to my Granddaughter Margaret France when she shall arrive at full age one cow one book and half the household furniture and one Spinning Wheel, and the said Margarett France twenty Dollars whenever she shall marry and on touching all the rest now due and remainder of my estate real and personal of whatsoever kind it may be after my just debts for land and any other that are just may be paid as above. I give and bequeath to my five daughters equally divided after a valuation from Barbery Spunaugle fourty Dollars that she have already received and from Eliza Ruse a deduction of twenty five Dollars which she have [_____] already, both from their dividend that they may receive that is to say one fifth part to my daughter Elizabeth Tumbleston, one fifth part to my daughter Barbarey Spunaugle one fifth part to my daughter Eliza Ruse one fifth part to my daughter Mary Shomaker one fifth part to my daughter Margaret Underwood, and as for my son Peter France my will is that he shall not have any more of my rest or personal Estate than he is in posession of and $100 already received. Lastly I nominate Constitute and appoint Steven Ford and Peter He[?] of Jefferson County State of Ohio to be the Executors of this my last will and testament. In witness whereof have hereunto set my hand and affixed my seal the 20th day June 1805 in presence of us at his Request have subscribed our names. Gutshull [?] [signed] [Georg Gottshall ] State of Ohio Jefferson County At a Court of Common pleas held at Steubenville within and for said County on Tuesday the fifth day of August Anno Domine One Thousand eight hundred and six personally came George Gutshall and Jacob Narragough two of the subscribing Witnesses to the foregoing last Will and Testament and severally made oath that they did see Nicholas France the Testator therein named Sign and Seal this Will and that they heard him publish pronounce and declare the same to be his last Will and Testament that at the time of his so doing he was to the best of their Apprehensions of sound and disposing mind memory and understnding and that they respectively subscribed their names thereto in the presence and at the request of the Testator and in the presence of each other.
