WILL OF SAMUEL BRADLEY (1812)

 

IN THE NAME OF GOD AMEN. This seventeeth day ofAugust in the Year of our Lord one thousand eight hundred and twelve,and of the independence of the United States of North America thethirty seventh--I Samuel Bradley of Salem, Sumter district and Stateaforesaid being in perfect health of body and sound mind and memory,thanks be to God for the same, calling to remembrance my mortality,and knowing that it is appointed for all men once to die, do make andordain this my last Will and Testament, That is to say Principallyand first of all to assign my soul to God who gave it, and my body tothe earth, to be buried in a decent Christian like manner, and astouching such worldly estate as it hath please God to bless me with Igive and bequeath in form and mannerfollowing-----------------------------------------------------------------------------------------

ITEM It is my Will and desire that all my Justdebts and funeral charges be paid out of my Estate--

ITEM it is my Will and desire that all my Estateremain together for the support of my beloved wife, and the Boardingsuitable clothing and Schooling my children so far as a good Englisheducation, and that no charges shall be make against them or any ofthem for the same, but it is to be considered as a general expenseand paid out of the income of my estate, in the same manner as if Iwas still alive.

ITEM It is my will and desire that my personalestate be equally divided between my beloved wife Mary Bradley, andmy six children my said wife to have a childs part, or share equal toone of my children, to be divided in the following manner (Viz) Whenone of my children shall arrive to the age of twenty one years, ormarry, my Executors (hereafter to be named) shall appoint fivedisinterested freeholders who shall appraise my whole personalestate, and alot and assign to the heir thus becoming of age ormarring (as the case may be) if the widow and six children be alive,the one seventh, if one of them be dead, the one sixth, or if two bedead the one fifth part of the estate so appraise, and the remainderof the estate to continue together for the support of the rest ofthe family as aforesaid, and when the rest of my children shallrespectively arrive to the age of twenty one years or marry myExecutors shall appoint appraisers as above directed, who shall a lotand assign to the heir thus becoming of age or marrying, a share orsaid Estate equal in value to the share given to the first and nomore. And in like manner to each heirs as they respectively become ofage or marry, until all shall have received their respective sharesequally. And in case my said wife Mary Bradley should apply for hershare of the personal property, My Executors shall proceed to set offher share any appraisement, in the same manner as above directed fora childs part, and on her receiving her part of said Estate she shallbe excluded from any further support from the undivided estate, whichpersonal property so allotted and delivered to said beloved wife andchildren respectively shall be absolutely vested in them and theirheirs forever, and should the estate increase after the firstappraisement so that by giving to the widow each of the Childrentheir respective equal share agreeable to that appraisement, abalance should still remain in the hands of the Executors, then andin that case, the said over plus shall be equally divided among allmy heirs--my Wife being one

ITEM I give and bequeath to my son Milton Bradleythe Northerly half of mosily all of any lands situate on the Westside of Black River Swamp extending into said swamp, consisting ofseveral tracts adjoining each other, to be divided agreeable tovaluation by appraisers for that purpose by my Executors, by a linerunning easterly and Westerly without any regard to the number ofAcres in either tract when he arrives to the age of twenty one yearsor day of marriage. Until which time, it shall remain together withmy other undivided estate in the possession of my beloved wife MaryBradley. And on my said son Milton being put in actual possession ofthe said Northern mosely of said Lands he is to pay over to mydaughters one hundred dollars each in lieu of their shares of saidLands---

ITEM I give and bequeath to my son Samuel LeroyBradley the southern half or mosely of the Lands above described, butsaid lands are to remain in the possession of my beloved Wife duringher widowhood and on my said son Samuel Leroy Bradley, being put inactual possession of said mosely of land he is to pay over to each ofmy daughters one hundred dollars in lieu of their share of said landsand should either of my said sons die under age or before marriage,then the survivor to heir the whole of said lands, by paying theabove mentioned Legacies--- and it is further my will and pleasurethat all my other lands not mentioned above be equally dividedbetween my sons Milton and said Leroy---Futhermore I do nominateconstitute and ordain my beloved wife Mary Bradley Executrix, and mygood friends John Perry, David Mitchell, James Bradley, SamuelBradley Junr and William Bradley Executors of this my last will andTestament with full power to execute the same without applying to anycourt for authority to make any of the above mentioneddivisions&emdash; and I do hereby disallow disannul and revoke alland every other Wills and Testaments and ratifying and confirmingthis and this only to be my last will and Testament--In Witnesswhereof I have here unto set my hand and Seal the day and year firstabove written---
