In the Name of God Amen, I Thomas Brumby Planterof Claremont County and State and District aforesaid, being Weak ofbody the Sound in mind memory and understanding, My praise be to Godfor the Same, I do make this my last Will and Testament. in Mannerand form following. I Will that my Estate be kept, together and not,Divided untill the first day of January, in the Year of our Lord onethousand eight hundred and eighteen, except. my Lands, which, I Willand impower my Executors, and Executrix hereafter, named, to Sell byprivate Contract. any tract. or tracts. of my Lands, both for thepurpose of paying my Just debts, and purchasing Negroes for my estateand to make good and Suffecient, Titles, for the Same Except onetract. of land. Which I Will to my beloved Susanna Brumby in Lieu ofher dower, which tract. of Land I do not Name, but Will that Mybeloved Wife Susanna Brumby May Chose, any tract of Land belonging tomy Estate, the Same being for the use of her self and my Children,While they Remain With her, and then to remain my beloved Wifesduring her life and at her death, to revert to my Children, Should mybeloved Wife Chose the tract of Land that I now live on it mustInclude the one half of a Tract of Land that I Bought from JohnDinkins, and a tract of land that I bought from Isham Moor Which landJoin and are included in the plantation that I now live on, I furtherWill that should my beloved Wife Chose any particular tract of myland, and wish to exchange it for any other tract. of my land duringher being an Executrix untill a final Devision of my Estate takesplace that she my beloved Wife Susanna Brumby, has full andsufficient power to do so, I further Will in Lieu of dower to mybeloved Wife Susanna Brumby when my Estate is divided, to be hersforever at her own disposal, her choice of my beds and bed furniture,Say one feather bed beadst.d and bed furniture. with all theremaining. part of my household and kitchen furniture (except theremaining part of my beding) I further will to my beloved wifeSusanna Brumby in Lieu of her dower to be hers forever at her ownDisposal when my Estate is divided one third part of all theremaining, part of my personal Estate except Such Negroes as may bepurchased for my Estate by my Executors or Executrix with moneyarising from the Sale of lands belonging to my Estate. after mydecease, I further Will that the remaining part of my beding asmentioned above be kep for the use of my Small Children or Such partof it as may be thought necefsary, I further Will that the remainingtwo thirds of my personal Estate. with all the Negroes, which may bePurchased by my Executors or Executrix with money arising from theSale of Lands of my Estate with all my Real Estate which may not beSold before the Devision of my Estate takes place, be equally dividedbetween my Seven Children, or as many as I may have at my Decease orin case any of them Should die to be equally Devided between mySurviving Children, though should any of my children Marry and diebefore my Estate is devided, and leave lawfull Ifsue then theirchildren Shall be Intitled to their Father or Mothers Share, of myEstate. I further Will that should my beloved Wife Susanna Brumby bepregnant at the time of my decease that that child be entitled to anequal share with the rest of my children, I further Will that shouldany of My children Marry before my Estate is devided, that myExecutors give to each of them after Marriage a Negro boy or girlbetween the age of twelve and twenty years old as Soon as such Negrocan be Bought. if not in hand at that time also a horse Saddle andbridle, and a bed and furniture, the Said Negroe horse Saddle andbridle to be given out of money arising from the Sale of Lands and tobe Valued and deducted from the Said Childs part also the bed andfurniture to be Valued and deducted from the Said Childs part of myEstate when my Estate is devided- I further Will then when My Estateis devided that my Sons, are not to take in their pofsefsion theirpart of my Estate untill they Arive at twenty one years old and thatmy Daughters, do not receive their Share untill they Marry or arriveto the age of eighteen Years old and that untill they Arive to thisAge that their Property and them Selves, Continue in the Care andunder the direction, of My Executors or Executrix, I further will andrequest of my Executors that they pay particular, attention to theeducation of my children- Lastly I do Will ordain and ConstituteReubin Long, John Grunning, Charles Millen and Matthew Moon mylawfull Executors. and my beloved Wife Susanna Brumby my lawfullExecutrix During her Widowhood, in Witnefs hereof I have hereunto Setmy hand and Seal this twenty Seventh day of December in the year ofour Lord one thousand Eight hundred and Seven, and in the thirtySecond year of American Independence
