JOHN BAXTER FRASER

 

 

In the name of God Amen. I John Baxter Fraser ofSumter district Planter, being of sound & disposing mind &memory, do make ordain and appoint This my last will and testament. I commend my Soul to its Creator and give my body to the dust whenceit came. As to the worldly estate with which it hath pleased God tobless me I disose them of in the following manner (Viz.) ----Item --I bequeath unto my son Samuel Fraser all the mony or chattels which Ihave heretofore loaned or given to him, except his two notes of handhereinafter otherwise disposed of --- Item I give & bequeath mynegro slaves young Ben, Diana her child Xury and her future increase,and the negro girl Delia & her future increse unto my said sonSamuel for and during his natural life, & at his death to thelawful issue of his body and if he should died without lawful issueliving at the time of his death then in that case remainder to thesurviving brothers and sisters or brother or sister of the saidSamuel equally to be divided between them share & share alike andin case any of the brothers and sisters of said Samuel should die inhis lifetime leaving lawful issue of their body living at the deathof said Samuel then in that case the lawful issue of such deceasedbrother or sister shall take the share which the Parent would havetaken had such Parent survived the said Samuel. Item I give &bequeath my wearing apparel to my son Samuel. Item I give &bequeath unto my said son Samuel my negro slaves Toney & Affy andtheir increase, and I do expressaly subject the said negro slavesToney & Affy her increase to the same limitations with thosefirst above given to my son Samuel in all respectswhatever----------------Item I given and bequeath my negro slavesCyrus, Milly and her children to wit Amoutta, Satira, and July and mywaiting Boy Primus, & her increase in future undo my daughterMary Fraser for and during her natural life and at her death to thelawful issue of her body, and if she shall die without lawful issueof her body living at the time of her death then in that caseremainder to the surviving brothers & sisters or brother orsister of said Mary equally to be divided between them share andshare alike, and in case any of the brothers and sisters of the saidMary shall died in her life time leaving lawful issue of their bodyliving at the death of the said Mary then in that case the lawfulissue of such deceased Brother or Sister shall take the share whichthe Parent would have taken had such Parent survived the said Mary

--------Item I bequeath unto my said daughter Maryall the money & Chattels which I have already loaned or given toher, the one half of my old Stock of Cattle one bed and furniturewhich she now has, one half of my silver teaspoons, the one half ofmy ivory handled case knives & forks, the whole of my tableservice bought at one time to be equally divided between her & mydaughter Jane Baxter Fraser and my riding horse & Chair, mylinnen not made up, and my looking glasses also to them in common. Item I give and devise unto my said daughters, Mary & Jane BaxterFrasers the plantation, about fifty or sixty acres of Land, whereonstands the dwelling house in which I now live, To have and to holdthe said plantation with its appurtenances unto them for and duringthe time they shall remain single, and whenever either of them shallmarry my intention and will is that the right of the one so marryingshall cease and determine, and that the one remaining single shallenjoy said premisses alone as long as so remaining single or untilher death, and after the marriage of both my said daughters or theirdeaths, then the remainder in said premisses I give & devise tomy youngest son Elias Lynch Fraser and to his heirs and afsigns. Item I give & bequeath unto my son William Hickman Fraser all themoney and chattles which I have hertofore lent or given him, and Igive and bequeath my negro slaves Caesar & his wife Dorcas,George, Liddy and her two children Lembrick and Dorcas and theirfuture increase unto my said son William Hickman for and during hisnatural life, and at his death to the lawful issue of his body, andif he should die without lawful issue living at the time of hisdeath, then in that case, remainder to the surviving brothers &sisters or brother or sister of the said William Hickman equally tobe divided between them share and share alike, and in case any of thesaid brothers and sisters of the said William Hickman shall died inhis lifetime leaving lawful issue of their body living at the deathof the said William Hickman, then in that case the lawful issue ofsuch deceased brother or sister shall take the share, which theParent would have taken had such Parent survived said WilliamHickman.-------Item I give and bequeath unto my daughter Jane BaxterFraser my negro slaves, George & his wife Brunette, Lucy &her two children To wit Peggy & Nelson, and my negro girlCharlotte and all their future increse for and during her naturallife, and at her death to the lawful issue of her body and if sheshall died without lawful issue living at the time of her death thenin that case remainder to the surviving brothers and sisters orbrother or sister of the said Jane Baxter, equally to be dividedbetween them share and share alike, and in case any of the brothersand sister of the aid Jane Baxter should die in her life time levinglawful issue of their body living at the death of said Jane Baxterthen in that case the lawful issue of such deceased brothers orsister shall take the share which the parent would have taken hadsuch Parent survived the said Jane Baxter. -------Item I give &bequeath unto my daughter Jane Baxter Fraser the part of my old stockof cattle which she claims one bed and furniture which she nowclaims, the remaining half of my silver teaspoons and of ivoryhandled case knives and forks my silve watch and gold chain also mygold sleave buttons and the remaining half of my table service.----------Item I give and bequeath unto my son John Fraser Glasgow,Tome and his wife Dince & her child Heriott and their futureincrease, for and during his natural life and at the dead of my saidJohn Fraser to the lawful issue of his body, and if he should diewithout lawful issue living at the time of his death, then in thatcase remainder to the surviving brothers and sisters or brother orsister of the said John Fraser equally to be divided between themshare and share alike, and in case any of the brothers & sistersof the said John should die in the life time of said John leavinglawful issue of their body living at the death of the said John thenin that case the lawful issue of such deceased brother or sistershall take the share which the Parent would have taken, had suchParent survived the said John.

Item ----I give and bequeath to my said Son Johnthe mone due me on his two notes being one hundred and sixty fivedollars, one feather bed, which he now has and the money and chattelswhich I have already loaned or given to him. ------Item ---- I giveand bequeath unto my son Thomas Fraser my negro slaves Judith, Frank,Prince, Silla & her two children. Viz. Sylva and Abigail andtheir future increase for and during his natural life, and at hisdeath to the lawful issue of his body, and if he should die withoutlawful issue of his body living at the time of his death, then inthat case remainder to the surviving brothers & sisters orbrother & sister of the said Thomas equally to be divided betweenthem share & share alike, and in case any of the brothers &sisters of the said Thomas should die in the life time of the saidThomas, leaving lawful issue of their body living at the death ofsaid Thomas, then in that case the lawful issue of said brother orsister shall take the share, which the Parent would have taken hadsuch Parent survived the said Thomas. -----Item ---- I give &bequeath unto my said son Thomas my horse called Dutchman and onefeather bed which he now owns, and all the money and chattel which Ihave already given or loaned to him ---Item -- I give and bequeath tomy son Robert Fraser my negro slave old Ben old Suckey is wife,Tyler, Nero, Dandy, Maria and her child Argen with her future incresefor and during his natural life and then subject in all respects tothe like limitations as is provided in the preceding clauses, asbetween the issue of said Robert & his brothers and sisters &their lawful issue. Item I give & bequeath to my said son Robertmy horse called Fox and the remaining part of undisposed of, of myold stock of cattle, and one feather bed. Item---I give &bequeath to my son Ladson Lawrence Fraser my negro slaves Dick, &his ife Kate, Nanny & her three children vix. Heram, Rufus, andSusanna with their future increse to him for and during his naturallife and then subject in all reaspects to the like limitations as isprovided in the preceding clauses, as between the issue of the saidLadson Lawrence and his brothers and sisters and their lawful issue.-----Item I give & bequeath to my said son Ladson Lawrence mysorrel filly and her increase to be equally divided between the saidLadson Lawrence and his broth Elias Lynch also I give to said LadsonLawrence one feather bed.----Item I give and devise unto my saidLadson Lawrence one feather bed.-----Item --- I give and devise untomy said son Ladson Lawrence the tract of land I bought of JamesMcNish, also the tract of land I bought of John (?)Reid---Item----- Iwill and direct that the money due me on my son Samuel's largest notebe appropriated to the purchase of Melton Bradleys land which liescontigous to my possessions, and when purchased I give and devise thesame to my said sons Ladson Lawrence and Elias Lynch equally to bedivided between them share & share alike to them for & duringtheir natural life and then subject in all respects to the likelimitations as is provided in the preceding clauses as between theissue of the said Ladson Lawrence and Elias Lynch and their brother& sister and thier lawful issue-----Item---I give and bequeath tomy son Elias Lynch Fraser my negro slaves Anthony, Ambrose, MarianneDaphan youn Suckey, and Sophronia and their future increse to him forand during his natural life and then subject to the same limitationsin all respects as is provided in the preceding clauses, as betweenthe issue of the said Elieas Lynch and his brothers & sisters andtheir lawful issue--- Item I give and devise to my said son EliasLynch all the lands I bought of Felix Ellis Jacob Barnes and AngusMcKay, always excepting the estate in part thereof herein beforegiven to my two daughters to him for and during his natural life andsubject thernin all respects to the like limitations as is providedin the preceding clases, as between the issue of the said Elias Lynchand his brothers and sisters and their lawful issue-----Item I giveand bequeath to aid Elias Lynch the one half of the stock of cattlewhich I bought at the sale of William Hickman's estate.----Item Igive & bequeath to my son Ladson Lawrence the remaining half ofthe stock of cattle which I bought at the sale of William Hickman'sEstate ----Item I direct that the money due me on my son Samuelssmall note be equally divided beftween the following children Mary,Jane Baxter, John, Thomas, Robert, Ladson Lawrence, and Elias LynchFraser's.-----Item --- I give and devise all that tract of Land whichwas conveyed to me by William Hickman to my sons John, Thomas andRobert Fraser to them to be equally divided between them share andshare alike to them for & during their natural life and thensubject in all respects the like limitations as is provided in thepreceding clauses as between the issue of the said sons John, Thomasand Robert and their brothers and sisters and their lawfulissue------Item----I will and direct that the negro wence Lucy ---that lucy which I acquired by marriage with my late wife, and her twochildren Libinia and Abeline & their future increase shouldremain with my daughters Mary & Jane Baxter and my sons LadsonLawrence and Elias Lynch Fraser until Elias Lynch my youngest sonshall arrive at the age of twenty one years, then the said Wench Luchand her children and their increase to be valued and appraised andequally divided between all my children, to wit Samuel, WilliamHickman, John, Thomas, Robert, Ladson Lawrence, Elias Lynch and mytwo daughters Mary and Jane Baxter Fraser to them for and duringtheir natural life and then subject tin all respects to the likelimitations as is provided in the preceding clauses as between theissue of the said sons and daughters & their lawful issue

---Item---i will and direct the mony due to me onson William Hickman's note to be appropriated to the tuition of mytwo sons Ladson Lawrence and Elias Lynch Fraser's------Item---I willand direct and bequeath the remaining part of my houseld furniturenot otherwise disposed of to my two sons Ladson Lawrence and EliasLynch, to be equally difived between them share and sharealike------Item I will direct and bequeath that my plow horses, plowsand other implements of husbandry and every other article belongingto or otherwise, or in anyway appertaining to my said House, Home andplantation, carts (---can't read..maybe saws or plows) plantationtools of all kinds milstones, grindstones, Carpentar's tools or ofwhatsoever nature or kind they may be and the crop standing on thegrounds, except so much to be apportioned to pay four parts of myjust & lawful debts, the other five parts of said debts to bepaid by sons Samuel, William Hickman, John, Thomas and Robert Fraserout of the several gifts & legacies-------
