WILL OF JOHN I (OR J) FRIERSON

 

In the name of God Amen. I, John I. Frierson ofSantee Clarendon County, Planter; being of sound & disposingmind; do make this my last Will & testament..---------- First--Idesire that my body be buried at the Episcopal Church in Stateburgwith the Vaughan family in a Christian-like manner----------

Secondly--I give, bequeath & devise to mybeloved wife Julia F. Frierson, a plantation, called Rural Plains forthe term of her natural life in lieu of Dower, I also give to her& her heirs forever all my household & kitchen furniture,also, a carriage & a pair of horses; and five thousanddollars.----------

 

Thirdly--I give, bequeath & devise to my sonJames J. Frierson the following Named Negroes (to make him equalwith his brother who has an estate independent of me) to wit. Paul,Dafney, Brutus, Isham, Amy, William, Rose, Boliver, Rachel &Flora and their future issue.----------

 

Fourthly.--I give & devise to my Son, JohnNapoleon Frierson my plantation or tracts of land known as the WibooLands.----------

 

Fifthly--I give & divise to my Son James J.Frierson my plantation or tracts of land called & known as theTaw Caw lands or plantation.----------

 

Sixthly.--I give & devise to my Son John N.Frierson my plantation or tract of land purchased of John M. Darganor Wm. Vaughan, know as the Blue Field.----------

 

Seventhly.--I give & devise to my son James J.Frierson, the tract of land or plantation devised to my wife for hernatural life, after her death.----------

 

Eighthly.--I do hereby authorize & empower myExecutors or such as them as act, to sell all the rest & residueof my real estate except two lots of two acres each on the West sideof the main road next to Durant's lot----in SumterVille, which I giveto my Said Sons one each. The proceeds of the Sales of my lands soldby them to be divided as hereinafter named.----------

 

It is my wish that my negroes be humanely treatedby my Executors & Sons particularly the old ones.---

 

It is my wish that my Son John N. Frierson finishhis education & that he & my friend, Genl. James W. Cantey ofCamden have my Son James J. Frierson Well educated.----------

 

Ninthly.--I give, bequeath & devise to my SonsJohn N. & James J. all the rest, residue & remainder of myestate not herein before disposed of, to be equally divided betweenthem, Share & Share alike, their estates to be divided by myexecutors appointing five disinterested persons to make the same, butthe said division not to take place until John N. Frierson is of ageor marries. Their estate to be delivered to them as theyrespectively come of age or marry.-----------

 

It is further my will & desire that the real& personal estate hereby & herein given & devised to mySons, Should either of them die under age or at any time leaving nochildren or child, or grand-children or grand child, the Survivor totake the Share of the one so dying. Should both of them die under ageor without children or child, grand children or grand child then thewhole thereof to my wife & her children or child forever, butShould she die without either children or child, then the Same to beequally divided between such children as my brother-in-law &sister-in-law (Henry Vaughan & Vermeille Rees) may have alive onthe event of my Sons & wife dying as aforesaid, but should it sohappen that my sons die under age or at any time leaving no childrenor child, grand children or grand child, also my wife die leavingneither children or child, also Henry Vaughan & Vermeille Reeseshould have no children to take as above mentioned, then the estategiven to my sons, to be divided into four equal shares; One share Igive & devise to the Methodist Conference of South Carolina.--Oneshare to the Episcopal Churches in the Bishopric of dioceses of SouthCarolina.--One share to the Presbyterian Presbytery of this part ofSouth Carolina.--One share to the Baptist State Convention of SouthCarolina if in existence & if not equally to the BaptistAssociation of South Carolina.----------

 

Lastly.--I nominate & appoint my wife Julia F.Frierson executrix, John N. Frierson, James W. Cantey, Henry Vaughan,Robert Bradford & Thomas Dugan, Executors of this my will &testament.---------
