Will of Walter James

In the name of God, amen, I Walter James of Sumterdistrict in the State of South Carolina, Planter being in health-ofbody and Sound mind Memory and understanding for which I thank God,do make this my will and testament in manner following.
First I give and bequeath-unto my wife the use of so much of myplantation where on- I now live as may be necessary for her to plantwith the negroes hereby given to her, with the use of the dwellinghouse & out houses as may be necessary for her use for the termof hir natural life the said plantation to be used by her and mychildren herein after mentioned in common to her and there mutualadvantage.- I also give to her for her lifetime only, the followingnegroes, to wit, Tom, Nancy, Nero, & Abba, the half of myplantation tools, Horses, cattle and Stock, provisions on hand at mydeath, & the half of my House hold & kitchen furniture, thisin lieu of Dower, and of her right & inheritance, in a tract orplantation of land which descended to her from her deceased brotherJohn Barder- herein give and delivered to my son John -------
Secondly -- I give devise and bequeath unti my son John James thatplantation of land which descended to my wife from her brother asabove stated, also Cinder and her family & their future increase,& a boy named Jim, and two of my horse but if he should die underage without issue then the said estate to be equally divided amongstmy younger children -------------------------------------
Thirdly I give and bequeath unto my daughter Caroline Montgomery toher sole and separate use free from the debts of her present or anyfuture husband for her natural life, as follows- a negro namedLizzett & her future increase & the sum of Three hundreddollars- and from and after her death to such child or children asshe may leave at her death ----------------------------------
Fourthly. I give and bequeath unto my daughter Penelope Montgomery,to her sole and separate use free from the debts of her present orany future husband for her natural life as follows, Cloe and Billy& their future increase and from and after her death tosuch-child or children as she may leave at her death.
Fifthly. I give and bequeath unto my other children being my youngerchildren (and not either of the above named three) all the restresidue & remainder of my estate, also my plantation whereon Inow life after the death of my wife Easter James, also should my sonJohn die as above mentioned under age without issue, then the estateabove bequeathed and devised to him to be equally devided amongstthem as the residue of my estate, also that the property thereinbequeathed to them be continued & worked on the plantationwhereon I live, for their joint benefit they to live and reside withtheir mother, & to bear their proportionate part of the Household expenses to be educated out of the proceeds of their estate, insuch a manner as my executor herein after named shall think to theiradvantage & as their estate will permit; that as theyrespectively come of age or Marry that my executor do allot to &deliver to them respectively their proportionate parts of my estateexcept the lands which is not to be divided until after the death ofmy said wife -- By the term my younger children- I mean all mychildren except Caroline, Penelope & John--------------------------------
Lastly- I nominate and appoint John B. Miller executor here of andthe care of my said children, and do declare this to be my last willand testament. In witness whereof I the said Walt James have hereunto set my hand and seal this Seventeenth day of November in theyear of our Lord one thousand eight hundred and nineteen -------
