WILL OF THOMAS NIGHTINGALE JOHNSON

 

In the Name of God Amen, I Thomas NightingaleJohnson of Claredon County and State of South Carolina, being Soundboth in body & mind but knowing the uncertainty of life and theCertainty of Death and wishing to arrage my worldly affairs. so asat any time to meet the approaching Hour of Death undesturbed byeathly cares, I make and declare this to be my last and only will andTestament. First I desire that my body be decently Burried at the discretion of my Executors hereafter to be mentioned Secondly I giveand bequeath to my beloved Wife Mary all the property real &personal which I got by her with the increase of the negroes also theplantation whereon I now reside Together with its appendages, in lewof two small tracts which she brought in but which I have since soldalso Ten Milking Cows & Calves, the Stock of Hog and sheep theplow Horses, all the Carriage Horses, Carriage and Chair, a wagon andgears, plows plow stocks and every other plantation Tool necefsaryfor c!!!arring on Businefs also all the plate Kitchen and HouseholdFurniture to be to her and her Heirs forever, but when I say all theStock of Hogs and sheep I only mean those that belong to theSpringfield plantation, and it is my desire that as soon after theCrop is Finished gathering & ginning as pofsible which may be onhand at the Time of my dissolution, that the Negroes, Which Come bymy present Wife be returned to this plantation and all the rest besent to Jacks Creek there to remain except any two which Mrs Johnsonmay Choos to retain for the purpose of attending my Daughter-

Item, I Desire that all the Remainder of my Stockof Horses, Sheep and Wearing apparel Guns, Pistols, and every otherSuperflus article that my Executors may think uselefs. be emedeatelySold to the Highest bidder upon such terms as my Exors. May thinkproper, Item, after my Death and in Case then in the ground theSuperflus Stock and the debts due which I request may be EmedeatelyCollected are not Sufficient, then it is my wish that they would sellas many Negros as would amount to the Defecientcy as I sould not wihMy Exors. to pester themselves with working out my Debts, -

(Item) I give and bequeath to John Millen Son ofWilliam and Elizabeth Millen for the affection I bear his Father Twothousand Dollars, to be paid him on the day he shall arive at the ageof twenty one but if he should Sooner Die then the Same to remain asa part of my Estate as his other children will be Sufficientlyprovided for, (Item) I desire that my Exors, will give My Daughter asgood Education as her mothers Indulgence and Tendernefs will admither to gett, and that they do pay her Mother two Hundred Dollars preannum, in lew of Board & Clothing (Item) I desire that after MyDebts Shall be paid whatever Surplus, there may be of the annualincome of my Estate the Same Shall be put at Interest at theDiscretion of my Executors -(Item) I give and bequeath to my belovedDaughter Sarah to her & the Heirs of her body lawfully begotten.all the rest and residue of my Estate whaeresoever it may be foundboth real and personal but in case of her Death before marriage thenI direct that! ! ! the property both real and personal which IReceived by the death of my former Wife Nancy James, Except Such partas I have already Disposed, of do direct to the Heirs of late ColoJohn James, to be to them and their Heirs forever and to be dividedamongh them in Such manner as they may choose and the rest of myproperty both real and personal to be sold for Cash one Fourth ofwhich with what may be accumelated, to be to my beloved Wife Mary oneFourth to the orphan House establishment in Charleston and theremainder to my Father if he Survives me if not to his Heirs, Shareand share alike (Item) I had almost forgot My affectionate SisterElizabeth James, whose tendernefs of heart and attention to me inrepeated Spells of Sicknefs, not only Intitles her to my best thanksbut to a more pecunary remembrance and as I know her Fondnefs forReading I think nothing would be more greatfull to her than aLibrary, I therefore Desire that my Exors would pay her one hundredDollars, to ! ! ! be laid out in Books, - I also give My Dearlybeloved Sister Jane McCrady two hundred Dollars to purchase her aChair Horse, - lastly I nominate and appoint my husty Friends MatthewJames, Charles Cannon and my affectionate Brother Dtr. Joseph Johnsonto be my Executors, the former I would wish to take intire charge ofthat part of my estate left his Sister Mrs Cannons I Beg would takeIntire Charge of Businefs at Jacks Creek and my Brother Joseph ofwhat will necefsarly require to be done in Charleston Witnefs my handand Seal this twenty Second day of May one thousand eight Hundred andone, Signed Sealed and acknowledged in presence of,

I omitted to mention in the proper place that ismy will that should my Daughter Marry and have at her Death a Husband& no children that her Husband shall have the profits & useof the Estate during his lifetime and should she leave a Husband& Children then the Husband shall have the profitt & use ofit untill her children marry or Come of age-
