Will of Mary McGirth

Sumter Dist., South Carolina

 

 

In the name of God Amen, I Mary McGirth ofthe State and District aforesaid considering the uncertainty of thismortal life but being of sound mind and memory belised be God for thesame, do make and constitute this my last will and testament inmanner and form following (to wit)

First, I give to my great grandson IsaacLenoir, son of departed grand daughter Eliza N. Lenoir, a certainnegro woman named Lavinia and her two children Sally and Billy (ifalive) together with the future issue and increase of the same, tohim and to his children forever but should he die leaving no childrenthe said property is to be equally divided between my two great granddaughters, Martha E. Joy, wife of Francis Joy, and Louisa Boone, wifeof Thomas Boone and their children forever in manner and formhereinafter to be mentioned.

Secondly, I give to my great, great grandsonThomas Lenoir, son of my departed daughter, Martha C. Lenoir, wife ofThomas E. Lenoir, a certain negro woman named Moriah and her childSusannah (if alive) together with the future issue and increase ofthe same to him and his children forever, but should he died leavingno children then the

Said property is to be equally divided between mytwo great grand daughters, Martha E. Joy, wife of Francis Joy andLouisa Boone, wife of Thomas Boone, and to their children forever inmanner and form herein after to be mentioned.

Thirdly, I give unto James W. Joy of DarlingtonDistrict and state aforesaid in trust for (hereby constituting andappointing the said J. W. Joy a trustee of certain trust Estateherein after to be explained) Martha E. Joy, wife of Francis Joy andLouisa Boone, wife of Thomas Boone, two certain negroes, namelyMilly, a woman about forty years of age and sundry articles of smallvalue consisting of beds and so forth including all I may bepossessed of at my death, and now to the end that all the propertymentioned in this third item or clause of this my last will andtestament, namely Milly and Alice together with their future issueand increase and the beds and soforth including all I may possess atmy death and furthermore that the property given in the first andsecond item or clause of my will aforesaid to Isaac Lenoir and ThomasLenoir aforementioned, should the said Isaac and the said Thomas dieleaving no children according to the language of this my last willand testament as above expressed, may all of it rebound to the entireand separate use of my two great grand daughters aforesaid Martha E.Joy and Louisa Boone and their children forever- I repeat that I giveunto James W. Joy of Darlington District as aforesaid in Trust. Formy great grand daughter Martha E. Joy, wife of Francis Joy and LouisaBoone, wife of Thomas Boone, to them for their sole and separate usefor and during their natural life and after their decease to theirchildren to be equally divided between them, the property alreadymentioned, and which I will again mention (to wit) Milly a womanabout forty years of age and Alice her daughter about twelve years ofage and other property of small value consisting of beds and soforthand whatever else I may be possessed of at my death, and also all orany portion of the property given to Isaac Lenoir and Thomas Lenoirin the first and second clauses of this my last will and testament,should any of the same decend as is provided for in said clauses all,and all manner of the property aforesaid I give to James W. Joyaforesaid in trust as already mentioned for the sole and separate useand benefit of my two great grand children, Martha E. Joy and LouisaBoone not by any means to be liable for or subject too the debtsalready contracted or that may at any time hereafter be contracted bythe present husbands to wit Francis Joy and Thomas Boone as beforementioned or any subsequent husband that they the said Martha E. Joyand Louisa Boone may marry.

Lastly I do hereby appoint and constituteIsaac Lenoir and John Ballard executors to this my last will andtestament hereby, revoking, annulling and making void all othersheretofore made by me.

And after desiring that first of all my justdebts and funeral charges be first paid I do in testimony of theforegoing here- unto subscribed my name and affix my seal thisEighteenth of May, Anno Domini, One Thousand Eight Hundred and FortyFour.
