WILL OF JAMES McEACHERN

 

I, James McEachern, resident of Sumpter District, State of SouthCarolina, do hereby make my last will and testamentÉÉÉÉ.

 

It is my wish and desire that my Uncle Duncan McNeill of RobersonCounty, State of North Carolina, should after my discease collect allmy accounts, notes AC, and pay out of them whatever lawful debtsshould appear against my estate. Should the accounts, notes of whichI may have against any person or persons be more when collected thanwill pay my just debts, I desire that the overplus of the moneyshould be equally divided among my wife and three children: butshould the money arising from my accounts, notes AC when collectednot be enough to discharge my lawful debts, It is my wish that such apart of my other property as my Uncle Duncan McNeill shall judge bestbe sold and appropriated to that use. Whatever property there shallbe remaining after all my debts are paid, It is my wish that the sameshould be appraised and equally distributed among my family viz mywife and three children. It is my desire that my wife should have asa part of my estate that may fall to her share my Negro woman Linia. Should the Negro woman on valuation be found to be more than theproportion of my estate that may fall to my wife, when equallydivided between herself and three children, my wife is to make up thedeficiency on the part of my three children, so that they all possessan equal part. It is my wish and desire that my wife should possessthe Negro woman Linia and whatever other property may fall to hershare, during her natural life, but at her discease, the Negro womanLinia, her increase and whatever other property she may have as herequal share of my estate, should return to my children and be equallydivided among them. I appoint my Uncle Duncan McNeill my executor,witness my hand and seal, this ninth day of August, the year of ourLord one thousand eight hundred and fifteen.
