WILL OF STEPHEN MITCHELL

In the name of God Amen I Stephen Mitchell of theState & district aforesaid, being weak in body but-sound in mind& memory, do make & declare this my last will & testamentin manner & form following, first I resign my Soul into the handsof Almighty God, hoping & believing in a remifsion of my sins, bythe merits & mediation of Jesus Christ, And my Body I commit tothe earth to be buried at the discretion of my executors hereinafternamed, And my worldly estate I give and devise as follows.---

I will that my debts be paid out of my crop nowgrowing & provided the crop is not sufficient that so much of mystock as may be necefsary be sold to pay the balance of thedebt.---

Also I give & devise unto my beloved wifeAbigail Mitchell the use of my farm, plantation tools, the housewhere I now live, household & kitchen furniture, all my stock ofhorses, cattle, & hogs not otherwise disposed of, also thefollowing negroes, Sally, Sarah & Lunah & their futureincrease during her life time or widow hood for her use & benefit& for the maintenance & education of my children. &provided my beloved wife Abigail should or does marry again in suchcase I will & bequeath unto her during her life time a negrowoman called Sally & a bed & furniture, all of which I giveto my beloved wife Abigail in the foregoing manner in lieu of dower.In consequence of a deed of gift made to my daughter Susannah Tisdale& her children of a tract of land whereon she & her husbandChristopher Tisdale now lives also a negro girl called Lucy & astock of cattle it is my will & desire that she shall have theSaid property in lieu of any further share or part of myestate.---

Also I will that my sons (as they may marry orarrive at the age of twenty one years) have an equal dividend of theplantation whereon I now live except that part whereon my dwellinghouse is situated which I will to my youngest son Samuel Clark as hispart of the said land subject however to the use or support of hismother during life time or widowhood.---

I will to my son James a negro woman namedHannah.---

I will to my daughter Dinny a negro girl namedGinny.---

I will to my son Stephen a negro man namedShadrach.---

I will to my daughter Abigail a negro girl namedEliza.---

I will to my son Benjamin a negro boy namedAdam.---

I will to my son Dannel Clark a negro boy namedSamson.---

& I will to my son Samuel Clark a negro boynamed Nat.---

Those legacies to be paid over or given ac/o tothe heirs as they may arrive to the age of twenty one years or asthey may marry Also it is my will should any of the children diebefore they arrive to age of twenty one years or without leavingifsue then in that case that their share or part revert back to myestate & be equally divided among my survivingchildren.---

also should any of the negroes die which are namedas legacies before the child to which it is named arrives at the ageof twenty one years then the lofs to the child so loosing its legacyshall be made good out of my estate, the remainder or residue, whenmy youngest child arrives at the age of twenty one years, or at thedeath of my beloved wife to be equally divided among mychildren.---

Lastly I constitute & appoint my son JamesMitchell & Hartwell Macon my executors to carry this my last will& testament into execution & effect witnefs my hand &seal this 24th Aug 1820
