WILL OF

 

JAMES HENRY MONTGOMERY

 

In the Name of GOD, amen, I James Henry Montgomeryof Clarendon County Sumter district planter, being weak in body butof sound mind and memory do publish and proclaim this my last willand testament.

First I give and bequeath unto my beloved wifeSeonora Gamboll Montgomery a Negro wench by name Cender an her fourchildren viz Sueky, Rachel, Bob and Getty

Secondly, I five and bequeath unto my beloved andonly child Mary Ann Montgomery, the six following negro slaves vizPompay, Eliza and Celvia & Celvia's three Children, named, Peter,Bsuhus & Isaac; and it is my wish & desire the three firstmentioned negroes, Pompay, Eliza & Cilvia to be kept as houseservants and never to be put in the field to work.

Thirdly, I give and bequeath unto my beloved andonly child Mary Ann Montgomery the plantation I now love on and allother lands that I either have in possession or a Just claim to , andalso two thirds of my personal property including Negro slaves,furniture & stock of every kind, which except what is of thepersonal property already disposed of is to be given up to her eitherwhen she arrives at the age of eighteen years or in Married if itwill be her desire then; Otherwise the Executors to continue incharge of it until it is her wish to take possession of the same

Fourthly I give & bequeath unto my belovedwife Seonora Gamboll Montgomery one third of my personal propertyincluding Negro slaves, furniture & Stock of every kind exceptwhat is already disposed of, with leave for her to live on theplantation during her widowhood.

Fifthly I give & bequeath unto the twoChildren of a free wench named Susanha their freedom Viz Sarina andMary

Sixthly it is my wish & desire that in case mybeloved and only child Mary Ann Montgomery departs this life beforeshe is married that her share of the property I now bequeath her willbe given to her mother SeonoraGamboll Montgomery to dispose of it asshe thinks proper

I constitute & appoint my wife Seonora GambollMontgomery my Executrix & Samuel E. Nelson & James Bennett myExecutors of this my last will and testament leaving in their chargethe care & education of my Child Mary Ann Montgomery togetherwith a request, that none of the Negro slaves that will be drawn saidMary Ann at any time a division takes place, will never be hired outbut all of them be kept together until she arrives at the age ofeighteen years or that she is married.

I also wish and desire to have some betterplanting land bought for the field hands to work whenever the Exr, afind that either the net proceeds of crops or money other wise cominginto their hands will enable them
