WILL OF JOHN MULLIN

 

In the name of God, amen, I John Mullin ofSumterville, being sick and weak in body, but of sound and disposingmind, memory and understanding, do make this my last will andTestament in manner and form following, to wit,

First--I give and bequeath unto my nephewAlexander Mullin the sum of Thirty Dollars to be paid to him if mydaughter dies leaving no child at her death---

Second-I give and bequeath unto my Brother JamesMullin for the term of his natural life, the work labour and use of anegro man-Slave named Tom, upon condition the he Cloth fead huse thesaid negro as if he were his own and paying my Executors hereafternamed one Dollar per annum, from and after the death of my saidbrother James, my will & desire is that the said negro bedisposed of as is herein after directed---

Thirdly It is my will and desire and I do herebyorder and authorise my Executors herein after named to sell of atPublic Sale all my Real Estate on a credit, taking from the purchaserBond, payable by equal instaments, at two, three and four years, withInterest from the day of Sale and also a mortgage of the same tosecure the payment there of, and that they when they do recive purchase money of my real estate that they do put the same out atInterest; and that they do yearly hireout all my negroes, takingsecurity for the payment of the hire and that they do sell all othermy personal Property and Collect as soon as pofsible all debts andmonies that may be due me at the time of my death and that they doalso pay, apply and dispose of the Interest arrising on the amount ofthe sales of my real estate, the money arrising from the hire of mynegroes and such sum or sums of money or Debts as shall be due orowing to me at my death, or so much there of as may be sufficient,for and towards the maintenance, education, support and bringing upof my daughter Panthia Miranda Mullin untill she attain the age oftwenty one years or marry (If she so long lives) which ever may firsthappen, and from and after my daughter arrive of age, marry or diethen the said negroes, monies, & lands if not sold, to bedisposed of as herein after mentioned.---

Fourthly-I give, Bequeath and Devise unto mydaughter Panthia Miranda Mullin and the Heirs of her body lawfullybegotten for her life time all my negroes including the one abovegiven to my Brother for his life time, after the death of my brother,also the monies arrising from the sales of my real estate or the saidreal estate if not sold as above directed, and all other my personalProperty, to be delivered to her on her arriving of twenty one yearsof age or day of marriage which ever may first happen for her lifetime and from and after her death, to such children or child as shemay leave at her death, But should my said daughter die leaving ather death no children or child, then and in such case my will anddesire is that the said negroes, the monies for which my real estatemay be sold or said real estate if not sold as above directed andother my personal estate, be divided in manner following, towit,

To William L Mullin, two negro men Slaves Tom andPeter and his heirs forever, To Sarah Mullin one negro woman Slavenamed Tens and her Heirs forever. To Susanna Mullin daughter of JamesMullin, a negro Girl named Jude and her Heirs forever. To Mary Mullinone negro woman named Agy and her heirs forever, To ElizaMullin-daughter of James Mullin, a negro Girl named Amy & herheirs forever. To John Mullin son of James Mullin one negro man namedWashington, & his heirs forever. To John Mullin son of mydeceased Brother Edward one negro man named Daniel and his heirsforever-To Susanna Mullin daughter of my deceased Brother Edward, onewoman named Jenny, and her heirs forever. To Eliza Mullin daughter ofmy deceased brother Edward one negro man named Jim, and her heirsforever, the rest, residue and remainder of my estate to be equallydivided between William, Sarah, Susanna, Mary, Eliza and Johnchildren of my Brother James and Susanna, Eliza and John, children ofmy deceased Brother Edward and their heirs forever, share and sharealike---

Fifthly-I nominate and appoint as Guardians to mydaughter Panthia Miranda Mullin, untill she arrive of age or marrywhich ever may first happen Spencer Wilder and John B Miller, or theone that will act as such---

Lastly-I do hereby nominate constitute and appointSpencer Wilder and John B Miller Executors of this my last will andTestament, hereby revoking and making void all former wills andTestaments at any time heretofore by me made and do declare this tobe my last will and testament.--- In witnefs whereof I, John Mullin,have hereunto set my hand and Seal this day of in theyear of our lord one thousand eight hundred and
