Will of Malachi Murphy

Sumter Disrtict} Be it made known to all towhom it may concern That I, Malachi Murphy Senr of the district andState aforesaid, do make, pronounce and forever declare this to be mylast Will and Testament, To wit, I wish after all my Just debts arepaid that my estate both real and personal to be divided in thefollowing manner, Namely,

I give unto my grandaughter, Elizabeth Murphy, thedaughter of Malachi P. Murphy, the following Negroes to wit, Dick,Selia, Sye, Binah, Cate and their increase, also one of the best beds& furniture with a parcel of household furniture and one hundreddollars in Money.

I give unto my Grandson, Michael Murphy theplantation whereon I now livewith the addition of a small tract ofland I purchased from General Canty, know as Randals land. Also onehundred acres to be taken of the tract of land I purchased fromFrancis Boykin known as the Lenoir tract taken off the side adjoiningmy old tract where I live -- also the following Negroes, to wit,Little John, Virginia, John and Rody with their increase-- but Idon't wish my said grandson Michael Murphy to have any controlManagement of said property until he becomes or arrives at the age oftwenty three years old.

 

I give unto my grand-daughter Harriet Murphy thefollowing Negroes, to wit, Phil, Rinah, Cloe and Mary and theirincrease--I give unto my grandaughter Jane Murphy the followingNegroes, Munday, Peggy, Duke and Peggys child, Mary and theirincrease.

I give unto my grand-daughter Mary Murphy thefollowing Negroes, Tom, Clarsea and her child, Bob and theirincrease.

I give unto my grand-daughter Nancy Murphy thefollowing Negroes, Sam, Fanny, and her child Lucy and blind Joe andtheir increase.

I give unto my son, Malachi B. Murphy, thefollowing Negroes, Jack, Little Jacob, David and Phenby and theirincrease.

I also give unto my grandson Malachi I. Murphy,son of Morris Murphy the remainder of the tract of land I purchasedfrom Francis Boykin after the hundred acres above mentioned is takenoff with the following Negroes, to wit, George, Isaac, Abram andDelia and their increase.

I give unto my grandaughter Massey Murphy thefollowing Negroes, Jim, Vine, and Dye with their increase. I giveunto my grandaughter, Martha Murphy the following Negroes, Manuel,Rose and Sharlotte and their increase.

 

I give unto my grand daughter, Hannah B. Murphythe following Negroes, Jacob, Ester and William and theirincrease.

The above legacies are not to be given up to anyof the named heirs until they become of age or marry but to be underthe direction and management of their parents who I wish to attend tothe education of said children and give them at least a good Englisheducation. Now in case either of my said grandchildren above namedshould die without lawful issue the part here given to such decreaseshall be equally divided between the surviving brothers and sisters,but in case the whole of the children of either Morris Murphy orMalachi P. Murphy shall die without lawful issue, in that case I wishthe Negroes and land here given and their increase to go to mysurviving grandchildren.

I also give unto my son, Malachi P. Murphy oneNegro man named Harry. I give unto Morris Murphy, one Negro mannamed Turkey John. I give unto my son-in-law, John Lowing, twodollars to be paid to him out of my estate.

I wish all the above mentioned Negroes to remainon the plantation until they gather and gin out the present cropwhich must be sold, the proceeds of which with what money may be inthe house be appropriated to the payment of my debts and then I wishMorris Murphy and Malachi P. Murphy to take possession of theirchildrens share of said Negroes.

 

I wish my stock of hogs, horses, cattle &c tobe sold under the direction of Morris Murphy and Malachi Murphy andthe proceeds to be equally divided between my said grand children. What money I may have in Charleston, I wish divided between MorrisMurphy and Malachi P. Murphy after deducting out of the same onehundred and fifty dollars to finish my new house.

I also wish my sons Malachi P. Murphy and MorrisMurphy to act and conduct my said estate as executors.
