WILL OF TABITHA POLK

 

STATE OF SOUTH CAROLINA, SUMTER DISTRICT

 

 

I Tabitha Polk of Sumter District andState aforesaid, being in a low State of Health, but of sound mindand memory, do make, constitute and ordain this my Last Will andTestament, hereby revoking all other former will or wills made byme--that it is say, after the payment of my Just Debts what worldlyeffects I am possessed of I give and dispose of in the followingmanner:

Item One: I give and bequeath to my two neicesHarriet R. Moore and Honoria M. Hunter, daughters of Matthew J. Mooremy brother, seven hundred dollars apiece, to be paid by my Executorswithin two years after my decease to them and their own seperate useand disposal forever.

Item Two: I give and bequeath to my nephewMatthew J. Moore, son of my Brother Matthew J. Moore, five hundreddollars to be paid any time within two years after my decease by myExecutors.

Item Three: After the payment of the above namedlegacies I give and devise to my brothers Richard Moore and JohnMoore equally the Plantation and Land whereon I now reside containingabout three hund & twenty acres together with my swamp lands nearSumter Landing in Richland District, adjoining the Wateree River, andcontaining about six hundred acres, together with all profits,advantages, heriditements and appurtenance to the same two tracts;belonging and also all my stock of every description and all myhousehold and kitchen furniture and all my bond, notes and accountsto be equally divided between them. One half to John I Moore and hisHeirs and Assigns forever, and the other one half to Richard Moore,and to John Moore after his death provided he, my brother Richard,die without lawful issue.

Item Four: I give and bequeath to my brother JohnI Moore all my negroes of every description, that is at my disposal,and also all my other property of every kind whatsoever, nothertofore mentioned and I am _____ of and entitled to, either in lawor equity with all their future increase to him and his heirs andassigns forever.

Lastly: I do hereby appoint my brothers RichardMoore and John I Moore my Lawful Executors, to take into possessionand to carry this my Last Will and Testament in Execution agreeableto the true intent and meaning thereof. In witness whereof I havehereunto set my hand and seal this twenty second day of September inthe year of our Lord one thousand eight hundred and twentyone.
