WILL OF MASON SPEARS

 

 

In the name of God amen. I Mason Spears Planterof Claremont Counter Sumter District, South Carolina, Consideringthe imortality of this mortal life, and being of sound and perfectmind and memory (blessed be almighty God for the same) do make andpublish this my last Will and Testament in manner and form following.

 

First I leave a Tract of Land lying on the Hillsbeing a part of the Lanch which belonged to William Hampton Deceasedto be sold to pay my Debts. Secondly, I give and bequeath unto mybeloved Wife Elizabeth Spears one Negro man name Big Jim, one NegroGril named Lender, also a Bed and furniture and my Riding Chair, andChair Horse name Canada in Liew of her dower to be at her intiredisposal either at Mariage or death. Thirdly, I give and bequath tomy Daughter Elizabeth Atkinson one Negro Girl named Milla (?or Willa)and three hundred dollars to be Levied out of my estate, with theincrese of said negro girl. I further give and bequeatht o my sonAustin Spears two Negroes named Jacob and Linda and increase. Ifurther give and bequeath to my Daughter Aloaf Spears two Negroesnamed Anthony and Caty and increase. I further give and bequeath tomy son Richard Hampton Spears two Negros named Sam and Hariot andincrease. I further give and bequeath to my Daughter Matha GrenierySpears two negroes named Prince and Rina and increase and I alsogive and bequeath to my son Theadore Mason Spears two Negroes named Admiral and Leuser and increase. These legacees to be taken atmarriage or the age of twenty one years. But if any of theseNegroes should die, before taken into possession then the Legateesshall take another out of my Estate near the same value. Fourthly Igive and bequeath all the rest of my Property real and Personal toremain for the support of my wife and children untill my sonTheadore Mason Spears shall arrive at the age of eighteen years, atwhich time all my Estate not particularly bequeathed above shall be equally divided amongst my Six Children above mentioned, Exceptingthe Tract of Land and improvements where I now live which I leavefor the use of My beloved Wife during Widowhood together with all mystock and furnature whatsoever, also any three Negroes not yetbequeathed above according to her own choice. But it is my willthat said Tract of Land mentioned in this fourth article withimprovements, Stock, furniture, and three negroes shall return in tomy Estate immediately after the marriage or death of my wife to bedevided amongst my six children above mentoned by five Judicious menas my Executors Shall Choose. And I do hereby appoint JeremahPitts, Austin Spears and Littleton Atkinson Executors of this mylast Will and Testment hereby revoking all former Wills by me madein witness where of I have hereunto set my hand and seal this twentyeighth day of March in the year of our Lord one thousand eighthundred and eleven and in the thirty fifth year of American Independence.

 

Signed sealed published and declared by the abovenamed Mason Spears to be his last Will and Testment in presence ofus who have hereunto subscribed our names as Witnesses in presenceof the Testator.
