WILL OF SPENCER WILDER

 

In the name of God amen, I Spencer Wilder ofSumter District, Planter being of sound mind memory and understandingdo make this my last will and testament.

First. I direct that all my debts be paid out ofthe Crop of provisions, cotton, & Stock that I may leave at mydeath after taking out the part I here in give to my wife.

Secondly. I give bequeath & divise unto mywife Sarah Wilder for and during the term of her natural life only inlieu & bar of dower the use of my plantation or lands where on Inow live also the following Negroes to wit, violet, Antony, Ephraim,Cosby, Emily & Laural, all my house hold & kitchen furnitureone third part of my stock of horses. and hogs. five cows and calvesthree two year old heffers and two two year old stears, and one thirdof the provisions, my riding chair & harnefs, my waggon &gears and Such of my plantation tools as may be necefsary forher--

Thirdly I give and bequeath to my grand son JamesLaurance Millett a negro boy named William To my grand daughterSarah Panthea Mellett a negro Girl Tomesey & her future increaseTo my grand daughter Margaret Elbina Mellett a negro girl Epsey &her future increase. it is my will that my Executors take charge ofthe three above negroes for my grand Children until they respectivelybecome of age or marry, but in the mean time their Mother to have theuse, work & labour of them as the property herein bequeathed intrust for her is given:

Fourthly I give and bequeath unto my daughterHulda Mellett five hundred dollars to be paid to her out of themoneys arising from the present Crop.

Fifthly-It is my will & desire that my son anddaughter take good care of my old servants Jim & Suckey duringtheir lives each taking one and keep them from hard labour &Supporting them comfortably during their lives.

Sixthly. I give & bequeath unto my executorsherein after named; the Plantation or tract of land which I purchasedof Jacob Ellmore, also the half of my personal estate not beforebequeathed, including in my personal estate that given to my Wife herlife time after her Death in trust, That is to say To have and tohold to them their executors, Administrators & afsigns, reposethis special trust & confidence that is to say, that they suffer& permit my daughter Hulda the wife of James Millett, to have theuse, work labour and profits thereof to and for her sole &seperate use during the term of her natural life not withstanding hermariage, free from the Contracts and debts of her now or any futurehusband and that from and after her death the said lands and personalestate to be equally divided amongst such children as she may leaveat her death, but if only one child that one to take the whole, butshould either of her children die under age or unmaried then thesurvivors or survivor to take the same among them on their becomingof age or Marry-But should my said daughter die leaving no childrenor child or should they die under age or unmaried, then and in thatcase the said lands and personal estate to my son and his heirsforever.

Seventhly. I give and bequeath & devise untomy son Thomas James Wilder and his heirs forever all my real andpersonal Estate not before bequeathed, including the plantation givento my wife her life time & the half of the personal estate givento her in same manner, but he is not to have the lands and personalestate given to his Mother until after her death.

It is my will that each of my children shall choseeach two persons, which said four persons shall chose a fifth todivide my personal estate. but that given to my wife is not to bedivided untill after her death.

Lastly-I nominate my friend Jefse Nettles Juniorand my son Thomas James Wilder executors of this my will---
