WILL OF JAMES H WILSON

 

The State of South Carolina

Sumter District this 30th day of August in theyear one thousand eight hundred and thirty Six. In the Name of GodAmen.

I James H Wilson of the State and destrictaforesaid; being at this time weak in body but of perfect mind andmemory, and Calling to mind the mortality of my body knowing that itis appointed to all men once to die. I do make and ordain this mylast Will & Testament. Principally and first of all I resign mySoul to God, who gave it, and my Body to the Earth to be Intered in adecent Christian like manner, And touching such worldly Estate as ithas pleased God to bless me with, I give and bequeath in the Mannerfollowing---

It is my Will and desire that all my Just debts bepaid as soon after my descease as pofsible, It is further my will anddesire that my Estate be Kept together for the benefit of my wife andChildren, until my Children become of Age, or marry, or the Marriageof my Widow, then in either Case it is my direction, that my Estatebe appraised (by three or five disenterested freeholders which myExecutors may designate for that purpose) and one equal Share, orShares (as the Case may be) to be given of to the one arriving at theage or marrying, the balance of my Estate to be again throwntogether, and again appraised, divided and given of as directed inthe first instance, and in like manner untill they all arrive at ageor marry-(That part of my Estate above alluded to is the personal andperishable, not including the real) I give to my wife Lydia JaneWilson one third of my plantation during her widowhood and no longer,at her marriage or decease I give the S.d one third to my SonBenjamin Franklin, the remaining two thirds of my Lands I give to mythree Daughters, Mary Elizabeth, Cynthea Caroline, and Martha Jane,to be appraised and given of in the Same manner as is directed in thepersonal part of my Estate To them and their Heirs forever. It is myWill and desire that Such of my children, have an opportunity ofreceiving a good English Education.

It is my Will and desire that my Executors carrythe provisions of this my Will into effect without applecation to theCourt of Law or Equity, further than is necefsary in suchcases

And for that purpose I hereby appoint my BrotherAbsalom Wilson Thomas I Dubose and my Friend William Harris,Executors of this my last will and Testament, revoking and Annuling,all others by me made in witnefs whereof I have hereunto Set my handand Seal this 30th of August in the year of our Lord one thousandeight hundred and thirty six and Sixty first year of AmericanIndependence
