Will of James Barnes

        

In the name of God-- Amen

I James Barnes of the State of South Carolina and Sumter District, Planter, being somewhat indisposed, but of perfect mind and memory and Knowing that it is appointed for all men once to die, do hereby ordain and make this my last Will and Testament. in the manner and words following.-Viz- principally and first of all I give and recommend my Soul into the hands of Almighty God who gave it, and as touching such worldly Estate wherewith it hath pleased him

to blefs me in this life I give and bequeath in the following manner.---

I give and bequeath unto my eldest Daughter Elizabeth Barnes one negro woman named Phillis with her two Children, Daniel and Ellen, also one Bed and furniture, one Horse, saddle and Bridle which said property with all its increase I give unto her and her heirs, Heirs of her Body forever.---

Item. I give and bequeath unto my eldest Son James L. Barnes one negro Boy named Leiw, one Bed and furniture to him and his Heirs forever. ---                                                     

Item. I give and bequeath unto my Daughter Martha W. Pitts one Horse, Saddle and Bridle in addition to that which she has already received, to her and her Heirs, Heirs of her Body forever.--

Item, I give and bequeath unto my Son Isaac L. Barnes one negro Boy named Kit, one Horse Saddle and Bridle, one Bed and furniture to him and his Heirs forever.---                    

Item,. I give and bequeath unto my Son John F. Barnes one negro Boy named Tim, one Horse, Saddle and Bridle, one Bed and furniture to him arid his Heirs forever.---        

Item,  I give and bequeath unto my Son Wilkerson Barnes one negro Boy named Reubin, one Horse, Saddle and Bridle, one Bed and furniture together with a Sufficiency from the balance of my property to educate and maintain him untill he arrives to the age of twenty one years.--- Item,, I give and bequeath unto my beloved Wife Mary Barnes during her natural life twenty seven negroes namely. Peter, Martin, Jack, Carolina, Hannah, Sucky, Betty, Milly, Sam, Will, January, Jacob, Nelly, Peter (a child) Jack, Venus, Rachel, Hannah (a girl) Barnet, Nelus, Miles, Dave, Melinda, Louisa, Syphax, Eliza and Robin; together with all my Stock of Horses, Hogs, Cattle and Sheep, Blacksmith Tools, Carpenter’s Tools and farming utensils of every description, Household and Kitchen furniture: in order to aid and afsist her in raising and supporting my Children untill they arrive at the age of twenty one years (or if they or any of them marry before they arrive at that age their supply then to cease or remain at my Wifes pleasure) I also give unto my wife Mary Barnes during her life time all the Lands whereon I now live (in Sumter District) being three Hundred and thirty eight Acres.-- also the tract of Land where we live during the Summer Months near Hugh Mathis containing one Hundred Acres more or lefs (also in Sumter District) in addition to the above bequest for the purposes above mentioned and after her decease it is my will and desire the Tract of Land where my House now stand containing one Hundred and sixty two Acres(being the same which I bought from Charles Cafsity) shall then belong to my Son Wilkerson Barnes: and the other two Tracts or parcels the one adjoining that where I now live which I bought from Samuel Davis, the other near Hugh Mathis which I bought from Rolin Pollard I will to be sold and the money to be equally divided amongst all my Children. Viz. Jannet Bates, Martha Pitts, Elizabeth, James, Isaac, John and Wilkerson Barnes.  Item,, it is my will and desire that all my Right, Title and Interest in a certain Tract of Land containing thirteen Hundred and forty three Acres belonging to  Thomas Hall, Estate of David Thompson and myself, lying and being in Kershaw District on the waters of  Scapewhore; shall be sold and the money then arising to be equally divided amongst all my Children: Viz: Jannet Bates, Martha Pitts, Elizabeth, James, Isaac, John and Wilkerson Barnes.     Item; It is my will and desire that the twenty seven negroes before specified which I have given my wife Mary Barnes during her lifetime, shall, after her decease with their increase be appraised and equally divided between all my Children; Viz Jannet Bates, Martha Pitts, Elizabeth James, Isaac John and Wilkerson Barnes with out selling any part, or portion of said negroes. --- I give and bequeath unto them and their Heirs forever.

Item., It is my will and desire that all my property of every Kind and description shall remain together as it now stands untill all my just and lawful debts bo discharged.--- Item., It is my will

and desire that after the decease of my wife Mary Barnes (my lawful debts being discharged) that all the balance of my property of every Kind and description; not before particularly specified and bequeathed shall be sold and the money thence arising shall be equally divided between all my Children.. Viz: Jannet Bates, Martha Pitts, Elizabeth James, Isaac, John and Wilkerson Barnes.‑

Item: I do hereby constitute and appoint my wife Mary Barnes Executrix and my Son John F Barnes Executor to this my last Will and Testament revoking annuling and making void all others heretofore made by me; to which I afsign, seal and deliver as my last will and Testament on the fourth day of December in the Year of our Lord one thousand eight Hundred and twenty four
