Will of Evan Benbow

 

In the Name of God Amen - - I Evan Benbow ofClarendon County in the district of Sumter and State of SouthCarolina Planter, being of sound mind memory and understanding Domake this my last will and Testament As follow to wit -----

First I give bequeath and divise to my belovedwife Martha Benbow the use of all my rale and personal Estate dureingher Widowhood-----

Item I give to my niece Rebeckah Tisdal and hirchildren forever four hundred dollars worth of property------

Item I give and devise to the children of BenjaminP. West Deceased four hundred dollars worth of property-----

Item I give and devise to the children of JosephC. West Deceased five hundred dollars worth of property-------

Item I give and devise to the children ofElisabeth Pardue four hundred dollars worth of property provided herhusband Leroye Pardue do pay to me or my estate the ballance of anote I hold on him for money lent him------

Item I give and devise to the children of MaryLong two hundred dollars worth of property------

Item I give and devise to Evan Benbow Clayton onehundred dollars in money-------

Item I give and devise to Evan Benbow the son ofEdward Benbow one hundred dollars in money------

Item I give and devise to Evan Benbow the son ofAdam Benbow one hundred dollars in money ------

Item I give and devise to Evan Benbow Carr son ofJohn Carr one hundred dollars in money-----

These nine Legacys amounting to two thousand threehundred dollars Is to be taken out of My estate before it is devidedas heare in after directed--------but should my beloved wife, MarthaBenbow Marry then I give and devise to her three sevenths of all mythe residue remainder of all my rale and personal estate meaning allmoneys in hand all debts due my estate and bank stock as my estate toher and hir heirs for ever, But should she Marry I do hereby authriseand impower her by will or deed hereby executed by her (the said willor deed not to take effect untill after her death) To bequath anddevise or convey by deed or will as afore said three Sevenths partsof all my rale and personal estate as she may chuse - - I do heare byimpower and direct my executors (but not my executrix) on themarriage of my beloved wife Martha Benbow or on hir death which everymay first happen to have my estate rale and personal devided asfollow that is to say that they appoint five respectable free holdersfrom amongest my nabours to divide my estate in to seven equal partsas may be and that they so deliver over to my said wife as soon afterher marriage as may be convenient three sevenths parts of thepersonal estate and Suffer her to take possession of her part of myrale estate, But should she never Marry that then they deliver thesaid three sevenths parts of my Rale and personal estate to theexecutors of my said wife if she leaves a will but if she disposes ofher said shears of my estate by deed then and in that case that theydeliver the said three Sevenths part to the persons claiming underher deed or will ----- The other four Sevenths parts of my estate Iwill and devise as follows to wit.

Item. I give and devise to the children of mysister Arcadia Tyson for ever the one forth part of the said foursevenths of my estate rale and personal ------

Item. I give and devise to the children of mybrother Edward Benbow deceased forever the one forth part of the saidfour Sevenths of my estate rale and personal -----

Item. I give and devise to my Brother GirshonBenbow the one forth part of the said four Sevenths of my estate raleand personal for ever -----

Item. I give and devise to the children of myNephew James Gibson the son of my sister Sarah Gibson deceased theone half of the last four Sevenths of my estate for ever -----

Item. I give and devise to Edward Benbow Gibsonthe grand son of my Sister Sarah Gibson Deceased and the son of EvanBenbow Gibson deceased the one half of the remaining last forth partof the four Sevenths of my estate rale and personal for ever. It ismy will that in case of the death of Edward Benbow Gibson leaving noisue lawfully begotten of his own body then and in such case the partof my estate left to him shall be divided between the Children of myBrother Edward Benbow Decesed and the Children of my Brother GirshonBenbow for ever -----

Lastly I do hearby Nominate and appoint My BelovedWife Martha Benbow my sole Executrix heare of during her widowhoodand after hir Marrage or death which ever May first Happen - I dohearby Nominate and appoint my Brother Girshon Benbow. My NephewDarkly Benbow -- Joel L. Grien -- and My particular freinds. JohnB. Miller Mathew James Adam Dingle -- William Conners -- James W.Belvin and John H. Ragin Junr My executors hear off. Heare byrevokeing all former wills and tentamants made by me -------

In witness where of I leave heare unto set my handand fixed my Soul This twenty first day of June in the year of ourLord one thousand Eight hundred and thirty four.
