Will of John Boyd

 

In the name of God, Amen:

I Dr. John Boyd of Sumter District and State of South Carolina, being sick and weak of body but of sound and disposing mind memory and understanding, praised be God for the same, do make and declare this to be my last Will and Testament in manner and for following viz:

 

First, it is my will and desire that all my just debts and funeral charges be respectively paid, and for the former purpose I do make such further provision as will herein after be more fully mentioned and set forth-

 

I give and bequeath to my daughter Margaret A. DuBose, the following negro slaves, to wit, Mariah, Sarah, and Adela,-also a negro woman Hetty already in her pofsefsion, with her four children Monday, Cornelia, Peggy and Clarifsa.

 

I give and bequeath to my daughter Susanna R. Boyd, the following negro slaves, to wit, Thomas, Ditny, Rachael, Cylinda, Robert, black Sarah, and Davy.

 

I give and bequeath to my daughter Dorcas M. Rhame the following negro slaves, to wit, Milly Harriet, Winter, Angelina, Emma, with Molsy and Robin already delivered to her:-to hold the said negro slaves during the term of her natural life, and after her death to descend to the heirs of her body.

 

I give and bequeath to my grand daughter Susan Richardson DuBose, a negro girl called Screna.

 

I give bequeath and devise to my three sons John J Boyd, Charles R.R. Boyd, and William S Boyd, the whole of my plantation or tract of land lying on Hungry Hall branch in Clarendon County, adjoining to lands belonging to Charles Conners and the Estate of Thomas N Johnson dec.d to hold to them their heirs and afsigns forever, and to be divided between my said sons share and share alike: also all  the remainder of my negro slaves not herein before given and bequeathed. And whereas I have made sale of a certain negro boy called Davy bequeathed to my son William S Boyd by Mrs. Margaret Sims in her last will and testament-now in lieu of the said negro boy Davy, I have given and do hereby confirm unto my son William S Boyd a negro woman named Kitty and her two children Delpha and Harriet.

 

I give and bequeath to my sons John J. Charles  R.R. and William S. Boyd and to my daughter Susanna R. Boyd, all my stock of horses and mules which I may die pofsed of, to be divided between my sons and daughter share and share alike.

 

It is my Will and desire and I do hereby direct, that my plantation and lands on Jacks creek adjoining lands belonging to John P Richardson, Thomas C Richardson and James B Richardson, and which were devised to me by the last will and testament of Mrs. Dorcas Richardson, be sold by my executors as soon after my death as may be convenient, and the proceeds thereof specially set apart as a fund for the payment of the following bequest and legacies:  that is to say: -to Mrs. Delia Boyd, four hundred dollars  to Mrs. Mary Cantey wife of Tachariah Cantey, two hundred dollars; to Mrs. Matilda Wilder, wife of Michael Wilder, one hundred dollars; to James Cantey son of Nelson Cantey, one hundred dollars:  To Susanna Boyd widow of my brother William Boyd, one hundred dollars:- to the surviving children of William Billups, one hundred dollars:- to the heirs or legal representatives of the firm of Stevens Ramsay & Co formerly of Charleston, one hundred dollars:- to Robert Blakely formerly of Charleston, his heirs or legal representatives,  one hundred and fifty dollars:- to Benjamin Hart, formerly of Charleston since of Kentucky, fifty dollars:- to my sister Elisabeth Andrews, a large mourning gold ring.

 

I do hereby constitute and appoint, my two sons John J Boyd and Charles R R Boyd to be the executors of this my last Will and testament, hereby revoking all others heretofore by me made.

 

In witnefs whereof I have hereunto set my hand and seal this thirteenth day of July in the year of our Lord one thousand eight  hundred and thirty seven.

 

Signed, sealed, published and declared by the said Dr.  John Boyd as and for his last will and testament, who at his request and in his presence, and in the presence of each other have subscribed our names as witnefses thereto.  The name of my son “Charles R R” erased and that of my son “ William S “ interlined in two places before signing also the legacy to Wm Boyd erased, and the work “my brother interlined, and the names  “Caty” and Vincent changed to Kitty and “Michael” before signing.
