WILL OF MARY CAIN

 

In the name of God, amen.    I, Mary Cain of Sumter District, Widow, being in health of body, & of sound mind & understanding praised be God for the same, do make this my last will & Testament in manner & form following.

 

1st.  I give and devise to my Son Richard Berry Cain, all my right title & interest, being one third part thereof respectively in & to the following two tracts of land viz.  The tract of about one hundred & Sixty two acres of land, on which the Dwelling House in which I now live is situated formerly purchased from the estate of Mark Linam also in the tract of about two hundred & seventeen acres of land, formerly purchased from Sarah Moore - to him & his Heirs forever -

 

2nd.   I give & devise unto my Daughter Emma E. Mellett, all my right title & interest in & to the tract of Land formerly purchased by my deceased husband William Cain from the Estate of Isaac Brunson Senior - Said tract containes about Six Hundred & Fifty acres of Land & my interest therein being one third part thereof - to her & her heirs forever -

 

3rd.  I give & devise to my daughter Bethia the wife of Colonel Caleb Williams all my right title & interest, in & to the following tract of land formerly purchased by my deceased Husband William Cain, as then the property of Merry Bracey - to her & her Heirs forever - viz - a tract  of about Seventeen Hundred acres of Land, on which Stark Singleton now lives - my interest being one ninth part thereof.

 

4th.  Whereas two tracts of land in which I owned an undivided one third part thereof have been sold, viz - a tract of land formerly Robert W. Andrews’ for the Sum of Three Hundred & Ten Dollars, and for which Sum a note or obligation is now held by the estate of William Cain - and one other tract of Land called the Bachmore Tract has been sold for sum of Seven Hundred & Fifty Dollars - & the purchase money invested in the purchase of a tract of land from the estate of Charles Linam for the use and benefit of the Estate of William Cain-  I give & bequeath to my son Richard Berry Cain and to my daughter Bethia Williams, equally to be divided between them - my interest in the two aforesaid sums of money - my interest being one third part of each Sum -

 

5th.  I nominate constitute & appoint Richard B. Cain, Colonel Caleb Williams & Francis W. Mellett, executors of this my last Will & Testament-
