WILL OF

R. L. COMMANDER

 

 

In the name of God, Amen. I Robert L. Commanderof the State of South Carolina and Sumter District being weak in bodybut of perfect mind and memory, blessed be Almighty God for the same,do make and publish this my last Will and testament in manner andform following (Viz) First: I will my body to have christian burial,and my soul to God who gave it. 2nd I hereby empower my executrixand Executors to sell any part of my perishable property which theymay judge for the interest of my Estate to dispose of; and after mylawful debts are paid, should there be any surplus money left arisingfrom said sail it is my Will that my Wife do receive the one thirdand that the balance be divided between my children share and sharealike, or appropriated, if necessary to their support. 3rd I giveand bequeath to my beloved Wife Mary L. Commander, my Clock, tables,Houses, the one third of my Lands, also the one third of my personalproperty Stock, and goods & chattels of every kind to be at herdisposal. 4th I give and bequeath to my children Emma CarolinaCommander, Martha Elizabeth Commander and the child with which myWife is pregnant all the rest, residue and remainder of my Estate,real and personal, together with the remainder of my Stock, goods andchattels of every kind whatsoever to be divided among them share andshare alike when they marry or come of age. 5th It is my Will thatmy Estate be apprais'd and divided as above directed by three or morefree holders chosen by my Executrix & Executors without an orderfrom any court whatever, the children to receive their dividends whenthe marry or come of age: and in case one or more of said Childrendie before they marry of come of age it is my Will that the survivingchildren or child shall heir the deceased child or childrens dividendof my Estate. And lastly, I nominate and appoint my Wife Mary L.Commander Executrix and William McCutchen, Robert A. McCutchen andGeo. McCuthen Senr. Executors of this my last Will and testament,hereby revoking all former wills by me made. In witness whereof Ihave hereunto set my hand and seal this twentieth day of Sepr in theYear of our Lord One thousand eight Hundred and forty three
