Will of Edward Daniel

In the name of God, Amen. I, Edward Daniel, ofthe State and District aforesaid being weak in body, but of a soundand disposing mind and memory. And calling to mind the frailty ofhuman nature and knowing it is appointed for all men to die, do makethis my last will and testament in manner and form as follows. And,first of all, I recommend my Soul to that God who gave it me. Nothing doubting a happy Resurrection. My body to be buried in adecent and Christian like manner at the discretion of my Executors. And as touch my worldly Estate what little it hath been pleased Godto endow me with, I give and dispose of as follows.

 

Having already given my son, John Daniel, and tomy daughter, Biah Allen, three parts of my property, I now give andbequeath to each of them five shillings sterling to them and thereheirs forever.

 

Item I give and bequeath unto my two sons, JamesJackson Daniel and George Washington Daniel, a tract of landcontaining four hundred and eleven acres lying & joining McLeodsMill Creek, Charles McLeads Land, Edwin Barnes and Jesse Allen's landto be equally divided betwixt them; also, one bed and furniture toeach of them and their heirs forever.

 

Item I give and bequeath unto my daughter,Elizabeth Eliza Daniel, two hundred and fourteen acres apart of thetract I now live on joining Jesse Allen's land also one bed andfurniture and one cow and calf to her and her heirs forever.

 

Item I give and bequeath unto my son, RansomYeats Bonner Daniel, the house and plantation where I now live,including two hundred and fifteen acres the balance of the tract, onebed and furniture, my bay mare and colt, one cow and calf, and all mystock of hogs to him and his heirs forever. Except what it will takefor the hogs to be sufficient for the support of my wife, SusannaDaniel, for one year. I, also, give unto the above named Ransom Y.B. Daniel, his mother Susanna Daniel, and Elizabeth E Daniel asufficiency of my provision crop for their support for oneyear.

 

Item my will and desire is that the balance ofmy property not disposed of above, be sold and the debts due mecollected and there with all my just debts to be paid and theexpenses of carrying this my last will and testament into effect. Andif any remain over, my will is that it be equally divided betwixtJames J. Daniel, George W. Daniel, Elizabeth E. Daniel, and Ranson Y.B. Daniel, my four youngest children. Also, my will is that themoney arising from my present Cotton Crop be put to the use ofdischarging my debts and support of my own family and schooling of myyoungest son, Ranson Y. B. Daniel.

 

I nominate, constitute and appoint, James J.Daniel and George W. Daniel, my Executors, to execute and carry intoeffect this my last will and testament. And, I, also, empower themto sell any of the legacies of land. And give rights agreeable to orby the consent of them to whom it is given by this my last will andtestament revoking all other will or wills theretofore by me made,but this only to be my last will and testament. In witness whereof,I have hereunto set my hand and seal this 21st November 1829
