Will of Judith Diggs

 

In the name of God, Amen. I, Judith Diggs ofSumter District and State of South Carolina being of sound anddisposing mind and memory, but having in view, the uncertainty oflife and being desirous of, disposing of all the worldly estatewhereof God has blessed me, do make and ordain this my last Will andtestament in words following to wit----Firstly, I direct all my justdebts to be paid, then to my son James B. Diggs I give my negro boyJim. To my son William G. Diggs, I give the two adjoining tracts ofland called the Bracey and the Pitol Tract, both together containingabout two hundred and fifty acres, more or lefs, also sum negroes,viz: Phil, Bill, George, Phoebe and her three children Nancey, Jamesand Elleck. To my daughter Mary S. Beach, I give six negroes, viz:Phenby and her five children David, Susan, Eum, Jordan and Margaret. To my daughter Amanda A. Wilder, I give the plantation and negroeswhere on I live also eleven negroes, viz: Jack, Joe, Milly, andtheir five children Bob, Lucy, Darby, Sam, Paul, Anna and her twochildren Mary and Martha, also my carriage and carriage horses. Idirect that my Sand hill place near Providence together with all myperishable property not herein specially given to be sold by myExecutor and the proceeds to be equally divided between my fourchildren, the part of William G. Diggs to be put at interest and theinterest only to be paid to him, at his death without heirs, thelands given to William G. Diggs to be equally divided between my twodaughters Mary S. Brach and Amanda A. Wilder. I wish it to beconsidered as given to them during their life time at their sole andseperate contract--the life estate not to be subject to the debts ofany other person, this bequest to them being intended for their soleand individual benefit and at their death or the death of either ofthem to be considered as entailed upon the lawful heirs of theirbodies respectively. I give to my friend William Sanders my mulecalled Jimy. I appoint my friend Isaac Lenoir executor of this mylast will and Testament. In testimony whereof I have hereunto set mysignature this twenty eighth day of December in the year of our Lord,one thousand eight hundred and forty three. This will executed inpresence of Jacob Little, Eliza Little and William Thomson, who inthe presence of the Testator and of each other have placed theirnames as witnefs thereof the day and year above written. Beforesigning of this will upon further consideration it is my wish thatthe property herein given to William G. Diggs should be considered asintailed, the property itself, nor the use of it to be liable to ortaken for his debts.
