Will of Amy Hampton

 

 

In the name of God Amen.

I, Amy Hampton of South Carolina, Sumter District,being of sound and disposing mind but advanced in years and frail ofbody, do make and publish this my last will and testament, herebyrevoking all wills and codicils heretofore made by me.

 

Item 1st. After commending my soul to God whogave it and my body to be decently buried. It is my will that all myjust debts shall be paid first, which I suppose may be done by debtsdue me and money on hand at my death or by the sale of stock.

 

Item 2nd. I give and bequeath to James M. Pitts abond which I held against him for the sum of fifteen hundred dollarsdated the 25th day of April 1842, secured by a mortgage of same dateof the negroes Miranda and her four children: Margaret, Frank, Mintyand infant Judith and child Darky which mortgage I also give andbequeath to the said James M. Pitts as also Matt.

 

Item 3rd. I give and bequeath my negro man Abramto Anderson Spears to him and his heirs forever. (All was struckout)

 

Item 4th. I give and bequeath unto Anderson A.Spears: Betty, Jim, Beckey and her children, Joe and Levinia andtheir future ifsue to be held and worked by him for the use of hiswife and children but subject in no way to his debts, contracts andengagements and at his death to be equally divided between hischildren then living and their ifsue of such of them as may be dead,such ifsue taking together the part that would have fallen to theirparent.

 

Item 5th. I give and bequeath to my niece AmyAdelade Spears my negro girl, Lucretia and her future ifsue to herduring her natural life and after her death to her children thenalive and the ifsue of such as may be dead, such ifsue takingtogether the part that would have fallen to their parent.

 

Item 6th. I give and bequeath to ElizabethLansdell, my niece: Jane, Easter, Flora, Isaac and Lavicy during hernatural life and from and after her death with their future ifsue toSusannah Brunson for her sole and separate use not subject to thedebts or contracts of her present or any future husband during hernatural life and from and after her death to her children thenliving, share and share alike absolutely in fee simple and the ifsueof such children of the said Susannah as may be dead at her deathsuch ifsue taking together the share that would have fallen to theirparent.

 

Item 7th. I give to Henry Spears: Levy, Eliza,Lina, Henry, Susanah, Emma and Charlotte with their future ifsue toand for the use of Joshua A. Spears during his natural life, heholding the pofsefsion and receiving the hire of said negroes andfrom and after the death of the said Joshua then to his childrenlawfully begotten, share and share alike absolutely freed from allTrust.

 

Item 8th. I give to Joshua A. Spears: Sam andRobin to and for the use of Henry Spears, the said Henry to hold thepofsefsion and receive the hire of said negroes but in no way subjectto his debts and contracts during his natural life and after hisdeath to his children lawfully begotten. But in case the said Henryshould die leaving no child, then Robin to go to Elizabeth Lansdellduring her life and after her death to Susan Brunson for her separateuse and to her children after her death as specified in the abovebequest to her and sum to go the child or children of Joshua A.Spears, share and share alike as specified in the above bequest tothem.

 

Item 9th. I give & bequeath Matt to JohnSpears (All was struck out)

 

Item 10th. I give one bed and beding to Amy A.Spears, one bed and beding to Melbry Ann Norton. I lend one bed toSusanah Brunson until James Clark comes or sends for it. The balanceof my household and kitchen furniture, provisions on hand or growingplantation tools and hogs to be divided among the negroes. My horsesand cows to be sold and given to Elizabeth Lansdell for the supportof old Cate and it is my request that Elizabeth Lansdell will takeCate under her protection and support her upon the above fund andallow her to do what she will for herself, but not compel her to workas a slave, but should Elizabeth Lansdell be dead or refuse, I thenmake this request to Susan Brunson and then to all my friends.

 

Lastly I appoint James M. Pitts and Joshua A.Spears Executors of this my last will and Testament. In witnefswhereof I have hereunto set my hand and seal in presence of the wordsand her heirs forever in the second line of the second page beingfirst erased.

Codicil

I give and bequeath to James M. Pitts, my negroman Matt, hereby revoking the ninth Item of my foregoing Will. Ialso cancel Item third of my foregoing Will. Signed, sealedand(delivered-struck out) published and the word "delivered" erasedfirst, in the presence of this 24th day Jany. 1843.
