Will of Henry Hudnall

IN THE NAME OF GOD AMEN

I, Henry Hudnall of the District and Stateaforesaid, do make and ordain this my last Will and Testament,revoking all former wills by me made.

 

1st. I give and bequeath unto my wife JaneE. Hudnall during her natural lifetime or widowhood, one Negro namenamed Sam. One Negro man named Amos. One Negro woman named Hannah;all my stock of cattle which I shall not hereinafter dispose ofotherwise, all my stock of hogs which I shall not otherwise disposeof. Ten head of sheep, one wagon, two mules called Little and BigJack; all my household and kitchen furniture except what I shallhereafter otherwise dispose of; one clock. But immediately after thedeath or marriage of my said wife Jane E. Hudnall that I give all theabove named property to my daughter Martha F. Hudnall, should thesaid Martha be alive at that time but should the said Martha be deadat the time of the death or marriage of my said wife then the abovenamed to be equally dividedbetween my four sons or the survivor ofthem.

 

2nd. I give devise and bequeath unto my sonIlia Nunn Hudnall two hundred and thirty-eight acres of land onDoctors Swamp whereon he now lives, purchased by my from John I.Frierson, also one Negro boy named Peter.

 

3rd. I give devise and bequeath unto my SonJoel Davis Hudnall the balance of the tract of land on Doctors Swamp,quantity not known. I also leave one Negro boy named Billy and oneNegro boy named Tommie. But should the said Joel D. Hudnall dieleaving no lawful issue then the said land and Negroes are to beequally divided between my three sons or the survivors ofthem.

 

4th. I give, devise and bequeath unto my sonJohn Hamlin Hudnall, the upper part of the tract of land called theThigpen Tract and lying on Horse Branch, the line to commence atPocataligo Swamp, run the same distance from the lower line that theshort ditch in the field called Amos Rice Pond ditch is from saidline straight to the run of June Burn Branch on the back line. Alsoone Negro boy named Lewis. One Negro girl named Edney. But shouldthe John Hamlin Hudnall die leaving no lawful issue then the abovenamed land and Negroes is to be equally divided between his brotherswhich may be alive at the time of his death.

 

5th. I give, devise and bequeath unto my sonHenry Bennett Hudnall the lower part of the tract of land called theThigpen tract. Also one Negro woman named Mitty. One Negro boyIsham. One Negro girl Binky. Two cows and calves. Two sows andpigs, one walnut desk, one feather bed, bedstead and furniture, onegray mare called Fancy, (should it so happen that the said mareshould not be on the place at the time of his arriving at twenty oneyears of age then I wish my executor to purchase for him out of myestate a horse worth seventy five dollars), one hundred and fiftybushels corn, fifteen hundred pounds of fodder out of the crop nowgrowing, also ten head of sheep. But, should the said Henry BennettHudnall die leaving no lawful issue then the above named property tobe equally divided between his brothers which may be alive at thetime of his death.

 

6th. I give, devise, and bequeath unto mydaughter Parthena Stokes one tract of land in Santee Swamp containingtwo hundred and forty-four acres.

 

7th. I give and bequeath unto my daughterSarah D. Davis one Negro child named Kitt.

 

8th. It is my will after paying all my justdebts and plantation expenses for the present year, that the proceedsof my cotton crop now growing be divided, this Ilia N. Hudnall tohave one half there of, the balance to be equally divided between mywife Jane E. My sons Joel D. And John H. The balance of myprovisions crop not disposed of I leave for the support of my wifeand daughter Martha.
