In the Name of God Amen. I Henry W. Hurst Beingin Sound Mind but Not So in Body do make constitute and appoint thisas my Last Will and Testament Knowing the uncertainty of this Lifeand that it is appointed for all to Die.---------------------
Item 1st. I Request my Executors hereinafter to benamed to pay all my Just Debts
Item 2. I give and Bequeath to my children-JamesP Hurst Samuel F Hurst William W Hurst Thomas I Hurst Dora Ann HurstElizabeth Hurst Sydney B Hurst all my property both Real and Personalto be equally Devided(sic) between my above named children, when mySon Samuel F Hurst becomes of the age of Twenty One years.
Item 3d . It is my Will and Desire that myPlantation Be kept up and all my Personal property to be kept on thePlantation and all the crops made on the Same after all Expenses arepaid out of the Same the Net proceeds to be used by my Executorshereinafter to be named to Support and Educate my above namedChildren till my Son Samuel F Hurst becomes of age at which time theDevision(sic) to be made as above Named-------------------
Item-4 It is my Will and Desire that my Executorshereinafter to be Named shall act as Guardians to my Children abovenamed till they Become of age and that they will hire out the Negroesthat each will be entitled to and the Money that may fall to theirShare in the Sale of the Balance of my personal Property be put outat Interest and the proceeds of the Hire and the Interest be appliedto the Support and Education of my Children till they become ofage.
Item 5. It is my will and desire that when my SonSamuel F Hurst becomes of age should my Executors think best and ofmore Benefit to my children that they Sell my plantation on Suchcredits as they think Best and the Principal of each Share be paid tomy Children as they Become of age. The Interest of the Same to beapplied to their Support and Education-it is also my Will and Desirethat all my other property (except my Negroes) shall be Sold at theSame Time above named and the Principal to be paid to my Children asthey Become of age the Interest of the Same to be applied to theirSupport and Education------
Item 6h It is my will and Desire that the Piece ofLand called Catchall and which said Piece or Tract of Land I gave tomy son Samuel F Hurst in a deed of gift shall not be deducted out ofhis share of my other property this is named so that their may be noDispute about the Same for I wish this piece of Land to be his overand above his Equal share of my property now willed
Item 7th It is my will and Desire that after allmy Debts are paid and Expenses paid that the Balance of the Money Imay have at my Death be Loaned out at Interest and the Interest to beused for the Support and Education of my children and principal to bepaid to my children as they become of age.
Item 8th I Request and Desire that my FriendsWilliam Sanders Senr. Jesse Kellingsworth Manson Sylvester andWilliam H Bowen act as my Executors to this my Last Will andTestament and that they also act as Guardians to my children tillthey become of age.
