Will of Daniel Kelly

        

In the Name of God Amen. I Daniel Kelly of Sumter District in the State of South Carolina, being Weak of Body, But Strong of Mind Memory and understanding for which I thank almighty God--Knowing that it is decreed for Man Once to Die I Make and Establish this My Last Will and Testament in manner and form as follows‑--

First  My Body to be decently Buried at the discretion of My Executors to be hereafter Named

Secondly. It is My Will and desire that all my Just debts be paid as Soon an pofsible--after my Decease---

Thirdly--I give and bequeath unto my Daughters Mary, Rebecca Suffrona Martha & Sarah Kelleys Five negro Slaves viz May Kate Howard Jerry and Juda also the Buildings and part of the tract of  Land whereon I now Live commencing at a crofs fence on the Richardson Tract thence on Easte Course to the Back Line thence on Said Line until it Strikes a Drean Near Mrs Tallons Land thence down Said Drean until it Makes into the Branch on the North of where I

now Live thence down Said branch until it gets apposite the North End of the Richardson Land thence a crofs to the beginning also fifteen head of Choice Stock Cattle, Two Mules and one mare abran  Also I give and Bequeath unto my said Daughters Mary Rebecca Suffrona Martha & Sarah the Household and Kitchen Furniture the Tools on the Plantation and a Supply of Provisions Sufficient for the Support of my Said Daughters & Sons Joseph & John Kellys to        Keep up the plantation, It is my will and desire that the Said Property given to my said Daughters Remain together So Long as they May Remain Single but in case Either of them Shall marry then it is my will and desire that the Personal & Perishable Property be divided So that Said Daughter that marrys May get her Shear‑--

The Land to Remain undevided So Long as any of Said Daughters May Remain Single and wish to Remain on Said Land, but in Case they Should all Marry or Said Land Divided, in that case it is my will and desire that Said Land be Sold or divided amongst them as they may think best---   

Fourthly  I give and bequeath unto My Son Joseph Kelly one Negro Boy Isaac also a Part of a tract of Land Bounded on the South by a Drean Leading from Near Mrs Tallons drean to the Branch on the North of where I now Live thence up Said Branch. to the Sumterville Road to the Back Line near the upper End of the Long Cyprefs thence acrofs to Mrs Tallons thence on her Land to the Beginning, also one young Horse in full against my Estate.

Fifthly I give and bequeath unto my Son John Kelly oneYellow Boy Jim

Sixthly I give and bequeath to my Son Henry Kelly one Negro Woman Junor & five dollar in full against my Estate---

Seventhly I give and bequeath unto to my Son Daniel E Kelly & My Daughters Elizabeth Beatseon & Leanora Bradham the following Negroes one man Jim and a Boy Joe to be devided amongst them Shear and Shear alike. I also give and Bequeath to my Sons Daniel E Kelly & John Kelly and Daughters Elizabeth Beatson & leanora Bradham My Richardson Land and old     Place where I formally Lived to be divided amongst them, or So1d and divided Shear and Shear alike which is in full against my Estate‑‑‑

Eighthly  it is my will and desire that the Residue and Remainder of my Estate be Sold and applied to the Payment of my Debts and after paying Said Debts if there Should Remain any Balance that it be applied to the Education of my Son John Kelly

Lastly I appoint my Friend Benjamin Pack & my Son Joseph Kelly Executors to this my Last will and Testament Revoking all former wills Made by me In testimoney I have hereunto Set my hand and Seal in presence of the Subscribing Witnefses acknowledging this to be my Last Will & Testament for the use & purposes therein Mentioned this Eleventh day of May in the year of our Lord one thousand eight hundred & forty one
