WILL OF C. KINLOCK

 

 

I appoint my brother F Kinloch, and my friend BHuger, and my nephew K Huger executors of this my last will andtestament.

 

I leave to my brother-in-law Wm Simmons, duringthe lifetime of my wife, and in trust for her use, the yearly sum ofone thousand dollars; to be increased if any increase should becomenecessary and to be a continued lieu on my estate, in preference toall that I leave to my brother F Kinloch, during his life, the use ofmy house and place called Acton, together with the use of all suchplate, linen, & furniture, as may be there, at the time of mydeath. To my friend, B Huger, I leave my watch. To my nephew, KHuger, I leave certain matters of account, known only to himself andto his brother.

 

The rest and residue of my estate, real, &personal, I leave to be equally divided among my children, upon thefollowing conditionsÉ. That they bring into hotchpot, whatever theymay have received of me. That my sons, if they choose it, may havethe whole of the tideland plantations, upon securing to myson-in-law, the full value of his proportions of the same.That mysons, if they choose it, may have as part of their share in myestate, the whole of the lands purchased by me from William Clarkson,William Crafts, Edward Crofts, & Robert English at the actualcost & charges.

 

That my son-in-law if he chooses it, may have, asapart of his share in my estate the whole of the lands purchased byme of Thomas Jones, & of the Sheriff of Sumpter District as theproperty of Rees, at the actual cost & charges.

 

That my son-in-law secure to my sons, the fullvalue of whatsoever he may have received of me, Will of C Kinloch andof whatsoever he may by this will, be entitled to receive out of myestate; the said full value to be payable, at his death, to mydaughter, if she should survive him; or in case of her death, to anyissue of hers, who may survive him; and if neither my daughter, norany issue of hers should survive him, then only two thirds of saidfull value, to be payable to my sons, their Heirs and assignsforever, and to be so payable only at the death of my son-in-law.MyExecutors are requested to destroy any manuscripts of mine, whichthey may think ought to be destroyed.
