WILL OF DANIEL McCASKILL


In the name of God, Amen. I Daniel McCaskill of Sumter District, in the State aforesaid being of sound mind make this my last will and testament—

I will and bequeath unto my five children by my former marriage Viz. Peter, Randal, Nennith, Christiana [who married Randal Campbell] and Jenny [who married John McQueen or John McDonald] twenty five cents each—

I will and bequeath unto my wife, Caty, during the term of her natural life or widowhood, and in lieu of her right and claim of Dower as my Estate, the use of the cleared part of the plantation on which I now live. With the houses and out houses—and privilege of five wood-rail timber and all necessary timber from my woodland—also, the use during her lifetime as widowhood of all my household and kitchen furniture, plantation tools, and utensils—and of three cows and calves—two sows and pigs and of my horse and mare.

I will and bequeath unto each of my three daughters, Sally, Nancy, and Mary, six head of stock cattle.

Unto my three sons, Little Donald, Allen and Charlie, I will and bequeath and devise all my real Estate [subject to the life estate of their mother in the plantation] excepting the part I have conveyed unto Big Donald and Angus: But should any of my said three sons, Little Donald, Allen, Charlie, die before arriving at the age of twenty one years and without leaving issue of the body then living, then I will, bequeath, and devise the part of my real Estate hereby bequeathed and devised unto them unto the survivor or survivors of them the said Little Donald, Allen and Charlie—Unto my five sons, Allen, Big Donald, Angus, Little Donald and Charlie, I will and bequeath all the residue of my stock of hogs and cattle and all my sheep, subject to the payment of my debts. And I also will and bequeath unto them the personal property in which as above I have given my wife as life estate, at her death or marriage after my decease.

I nominate and appoint my wife, Caty, and my son, Big Donald, Executor and Executrix of this my last will and testament. In testimony where of, I have hereunto set my hand and Seal this Twenty third day of March AD, One thousand eight hundred and twenty four and 40th year of American Independence.
