WILL OF THOMAS McFADDIN

 

 

In the Name of God Amen, I Thomas McFaddin of Sumter District, being of Sound Mind, Memory and understanding, praised be God for the Same do declare this my last will and testamentin manner and form following, that is to say ------

I give and bequeath unto my Son John, all my land that ly above a line to be run out from Humes land in the Savannah in a direct course by a White Oak Station that stands in the field to a Pine Corner at the Side of the Salem road just below the Nater pond from thence down the Salem road to home branch, from thence the most eastermost Course to the pudding Swamp road including all my land on Newmans branch on the east Side of pudding swamp road (that was formerly William Beards) to him and his heirs and Assigns forever, also one Feather bed and furniture and bed stead, and the one fourth of my Lybrary, and one fifth part of all my Negroes and other personall Estate, not herein otherwise disposed off, to him and his heirs and Assigns forever -------

I Give and bequeath unto my Daughter Elizabeth Witherspoon five Negroes named Peter his wife Silver and three children named, gordon george and Anne, and their increase and my Chair horse, and Mahogany Side board, and easing Chair, and Mahogany bed Stead feather bed and furniture and the one third of my glass andCrockery ware, and one fourth of my Lybrary, and one fifth of my negroes and other personall Estate, not herein otherwise disposed of, to her and the heirs of her body forever -------

I give and bequeath unto my Daughter Mary W. Muldrowall my land on Lynches Creek to her her heirs and Assigns forever ---- I also give and bequeath to my Said Daughter Mary W. Muldrow four Negroes named Sue, Carolina, Hester and child Bunon, and their Increase, and my riding chair, and Mahogany round tables, half a Dozen Mahogany Coloured Sitting Chairs, and Mahogany bedstead, Feather bed and furniture and the one third of glass and Crockery ware, and onefourth of my Lybrary, and the one fifth part of all my Negroes and other personall Estate, (not herein other wise disposed of) to her and the heirs of her body forever -------

I Give and bequeath unto my Daughter Margaret Addeline James my Mahogany Dining table and book case, one bed Stead,Feather bed and furniture, and one third of Crockiry and Glassware, one fourth of my lybrary and the one fifth of all my Negroes and Other personall Estate (not herein otherwise disposed of) also all that plantation and tracts of land where on I now live bounded Westerly on Humes land, South on John McFaddin Snr and Saml. McFaddins land, east on the pudding Swamp road, North on the line prescribed (as above) to my Son John, to her and the heirs of her body forever -------

I Give and bequeath unto (my grand Children,) the Children of my Deceased Son Eli the one fifth part of all my Negroes and Other personall Estate, (not herein otherwise disposed off) to them their heirs and Assigns for ever, and Shoud either of them die before Marriage and before the age of twenty one then their part to go to the Survivers, and Shoud they all die before Marriage or the age of twenty one then this fifth Share herein bequeath to them And their Increase to be divided between my heirs, to them their heirs and assigns forever -------

It is my will and desire that shoud any of my three Daughters Die Leaving no children at the time of their Death,or Should their Children of her so Dying all die before Marriage and before the age of twenty one then in eather of these cases the property herein bequeath to her, So dying, and all the Increase, tobe equally divided between my heirs to them their heirs and Assigns forever -------

It is my will and Desire that my Executors dochoose and appoint three or more freeholders to appraise, divide, allott, and Assign, to each one their Share of the property above Specifyd and make a return of Such Division, certifyd under their hand, unto the ordinarys office

I give unto my grand Son Thomas G. McFaddin my Silver watch -------

It is my will and desire that all the remainderof my estate, horses, hogs, Cattle, Sheep, and Sundrys, be Sold and Divided in five Shares, one Share to each, of My Children &one Share, to the children of my Diceased Son Eli -- to them theirheirs and Assigns forever -------

I do hereby Appoint my Son John, and Sons in lawRobt Witherspoon and John J. Muldrow Executors of this my last will & testament, revoking and making Void all other Wills at any time by me made and declare this to be my last will and testament,In Witness where of I have at the bottom of the first Sheet Subscribed my name and to this Second and last sheet my hand Seal this third day of Jany. in the year of our lord one thousand Eight hundred and twenty three -------
