Will of

 

CHARLES C. MOODY

 

State of South Carolina

 

Sumter District

 

 

I, Charles C. Moody of the aforesaid State and District being of sound mind, memory and understanding do hereby make and declare my last Will and Testament in manner and Form following--to wit—

 

I desire, First that my just Debts and Funeral expenses be paid.

 

I give and bequeath unto my brother Burrell Moody my negro man,  Peter, to him and his Heirs forever---

 

I give and bequeath unto my sister Elizabeth RICHARDSON, my two Negroes Maria and her child Sam to her, the said Elizabeth Richardson, during the term of her natural life and after her death, said negroes Maria and Sam to go over and belong to her children William, Martha, Elizabeth Frances, Thomas, and Alice and their Heirs forever ---

 

I give and bequeath to my brother James A. Moody, All that tract of Land Containing fifty six acres, and bounded north by lands of I.A. FRASER, East by Lands of Wm. WHEELER, south by lands of S.J. MURRAY and west by the Sumter Landing Road—I further give and bequeath to my  Brother James A. Moody, a Tract of Land of Twenty six acres on the west

Side of the Sumter’s Landing Road and adjoining Lands owned by Isaac LENOIR, commonly known as the MCLAUGHLIN Tract to him and his Heirs forever—

 

I give and bequeath to my sister Sarah R. ATKINSON, a negro girl Catherine and her future issue, to her, the said Sarah R. Atkinson, during the Term of her natural Life and after her death, said negro girl Catherine And her future issue to go over and belong to the children of said Sarah R. Atkinson and their heirs forever---

 

It is my desire also that the net proceeds of my crop, together with the proceeds of the sale of my furniture, farming and kitchen utensils, and also of the sale of my Cattle, Horses, and Hogs, be equally divided between my brother Burrell and my sister Elizabeth, my sister Sarah and my brother James and their Heirs---

 

It is further my desire that my nephew Sloman Moody be paid whatever is due him by me as administrator of my brother William H. Moody, and for that purpose I desire my Executors to use a certain Bond I hold against E.M. ANDERSON for Five hundred dollars, and should there be any residue after said debt is paid to my said nephew Soloman, such residue to be equally divided as above between my brother Burrell and James and my sisters Elizabeth and Sarah.—

 

I do hereby appoint my brother Burrell Moody and my friend, W.J. Atkinson, Executors of this my last Will and Testament---In witness whereof I have affixed hereto my hand and seal this Fourteenth day of March, In the year of our Lord eighteen hundred and fifty.

 

Signed, sealed and published as and for the last will and Testament of the Testator in our presence, who at his request and in his presence have subscribed our names as witnesses.
