WILL OF SAMUEL JAMESNELSON

 

 

I Samuel James Nelson of Sumter District do declare this to be my last Will and Testament:

1st I give and bequeath to My beloved Wife Caroline Nelson the following Negroes, Harriet and her Child Binkey,Boomer, and Sam, with the increase of the females, to her and Her Heirs: Also the Negroes Amelia and her daughter Yanica, with their future issue And increase, to my said Wife in Lieu of any claim of Dower which she may have to any Land or real Estate in My possession,or here after to be acquired by me, And on condition that she relinquishes her said claim of Dower, But if she should not accept the two said last mentioned Negroes in Lieu of her claim of Dower then they shall go to my children living at my death to be equally divided among them --- I further give and bequeath to my said Wife the use of my plantation so long as she shall remain my Widow and unmarried, together with my riding chair and chair Horse, one bedstead, bed and furniture and Eight head of Milking Cows -------

2nd I give and devise to my sons, James Harvey Nelson, John M.W. Nelson and such son or Sons as may hereafter be born to me all my real Estate, including the plantation, the use of which is given to their mother during her Widowhood, to be equally divided between them, share and share alike, to them and their Heirsforever, to be delivered to them when they attain the age of twenty one or marry; But if either of them shall die without attaining the age of twenty one years, or marrying then his or their part or partsof the said property to go to his or their surviving brothers or Brother -------

3rd I give and bequeath to my children James H Nelson, John M W Nelson, Sarah S W Nelson and such as may hereafter be born to me, all the rest and residue of my personal property to be equally divided among them, share and share alike, each one receiving his or her share as they attain the age of twenty one yearsor marry, and if either of them should die before attaining the age of twenty one years or marriage, then his or her part to return to the survivors or survivor of them -------

4th It is my desire that the House hold, Kitchenfurniture, Horses, Hogs and cattle not heretofore disposed of with other like perishable property, be sold for the payment of my Debts-- the ballance if any, to be disposed of by my Executors in the manner most advantagious to the Children -------

I do hereby Constitute, nominate and appoint John M Witherspoon, Jared I Nelson And Samuel E Conyers Executorsof this my last will and Testament -------

In testimony whereof I have hereunto set my hand this thirty first day of July in the year of our Lord one thousand eight hundred and thirty and in the fifty fifth year of American Independence -------
