In the name of God, Amen,-I Jacob Osteen of the District of Sumterin the State of South Carolina, being well in body & sound inmind-thanks for the same to our Heavenly Father- do make, declare,publish and ordain this as my last will andtestament.--------------------------------
In the first place I commit my body to the grave, trusting to aglorious resurrection through the merits of our Saviour &Redeemer.----------------------------------------------------------------------
I give 7 devise to my wife Dorcas for life the use of my buildingsand as much of the adjoining cleared land as she may have use forwith the privilege of fire wood, timber & fence stuff off of anypart of my lands- also the use of my horse & cart for her lifetime- & the use of all my stock for her life time- at her death Ibequeath the Cattle to my daughter Dorcas Giddens- & the landsabove mentioned with the same privileges I devise to my daughterRachel while single, - and I recommend her to the kind care &attention of her brother Thomas&emdash; On the marriage of mydaughter Rachel, I devise to my son Thomas in trust for the sole& separate use of my daughter Rachel for her life time&emdash;One hundred acres of land on that part of my tract adjoining the landhereafter to be devised to the children of my son Gabriel - at herdeath I devise the same to her children if she leaves any - &should she die without children then I devise the same to thechildren of my daughters Dorcas Giddens & Mahely Hutson whosurvive the said Rachel----------
I devise to my son Charles in trust for his children who may bealive at my death one hundred & fifty acres of land on that partof my tract adjoining land which I have heretofore given to my sonWilliam running from Mr. E. Pugh's land to Mac Kolb'sland.-----------------------------------------
I devise to my son Gabriel in trust for his children, who may bealive at my death, One hundred & fifty acres of land on that partof my tract adjoining the land above devised to the children ofCharles.-----------------------------------------------------
On the death or marriage of my daughter Rachel I devise to my sonWilliam, the piece of land whereon the buildings stand & theadjoining land which I have devised to my wife for life in trust topermit & suffer my son Thomas to use, occupy & enjoy the same- & the profits there of for the life time of the said Thomas.-and at his death I devise the same in trust for the children he mayleave surviving him- and should he die without children, then Idevise the same to the Children of my daughter Dorcas & Mahaleywho may survive the said Thomas.--------------
The James Giddings tract on which my son Willis now resides, Idesire him to have the privilege of occupying during his life- at hisdeath I devise the same to my son William in trust for my son Thomason the same terms, conditions & limitations as are set forth inthe last preceding clause.--
The little piece of land which lies adjoining Jacob Giddens landbetween him & Greenland Savanna Containing about thirty or fortyacres of land- more or less- I devise to my grandson JabGiddens.----------------------
All the remainder of my lands, I devise to my son William in trustfor my son Thomas on the same terms, conditions & limitations asare attached to the land above devised in trust for Thomas by clausesabove set forth.--------------The household & Kitchen furnitureexcept a bed & bed furniture, which I bequeath to Rachel, - Ileave to my wife for her life time, & afterward to Thomas &Rachel to divide- Rachel taking first choice---------------------
The Cart I leave to Thomas after the death of my wife- I leave thehorse after the death of my wife to Dorcas Giddens.-------------
The Plantation tools & blacksmith & carpenter's tools& wagon I leave to Thomas.--------
I wish my Executors to pay to Maria Garrett my grand daughterTwenty Dollars out of the portion I have left toThomas.---------------
I nominate & appoint William- Charles L. & Thomas Osteen,my sons Executors of this my last Will & Testament, herebyrevoking any other heretofore made.----------------
Witness my hand this 23rd day of September in the Year of our LordOne thousand eight hundred & forty six.-----------------------
