Will of Nancy Rees

 

  I Nancy Rees of Sumter district widow being of Sound & disposing mind tho in feeble health. Do make this my last will & testament as follows, to wit

  First I give & bequeath to each of my grandson’s Scarbrough Drake and Samuel H Drake a feather Bed & furniture.        

  Secondly, I give and bequeath unto my granddaughter Nancy Norris, for her life time only & to her sole & separate use, the following negroes, Nancy, Sarah, Easter, Bina, Eliza & Isaac & their increase & after her death to be equally divided between such children as she may leave alive. & the ifsue of deceased Child, taking amongst them the share of the deceased parent.

  Thirdly. I give & bequeath unto my granddaughter Mary  bell for her life & for her sole & separate use the following negroes. Poll, Nelly, & Julia & their increase & after her death to be equally divided between such children as she may leave alive & the ifsue of a deceased Child taking amongst them the share of the dec.d parent.

  Fourthly. I give & bequeath unto my grandson Scarbrough Drake. for his natural life only & to my grandson Samuel Herbert Drake for his natural life, the following negroes Castelia, Andrew, Jenney, Winny, John, Bin & Dave & their increase, to be equally divided between them & from & after their respective deaths their several & respective shares, to be divided between their respective & several children they may leave a live & the ifsue of a deceased Child, the ifsue taking their dec.d parents part.

  Fifthly. should either of my said Grand Children die leaving no children or child or ifsue of a child a live then the share of such one so dying to go the survivors

  Sixthly. I do hereby authorize my Executors to appoint three or more persons. to make partition of my estate as the same may be necefsary.

  Seventhly. The rest & residue of my estate to be equally divided between my said grand Children

  Lastly. I do hereby nominate & appoint Alexander Norris. Scarbrough Drake & Sam H Drake executors of this my will

I Nancy Rees for the purpose of making an alteration in a part of my foregoing will ‑ do hereby make the following division of the negroes given to Samuel H Drake & Scarborough R Drake and declare the same to be a Codicil to my foregoing Will & to be my final disposition of that part of my negroes- To wit -my will & desire is that my grand Son Scarborough, shall have the negroes Andrew, Jenny & her child Jim and Dave ‑ and that my Grand Son Samuel‑shall have the negroes ‑ John ‑ Castilio ‑ Winny & Ben‑ subject to the same limitations as are contained in the fourth clause of my foregoing will-‑ Signed Sealed & declared to be a Codicil to the fore‑

going will in the presence of us ‑ this eighth day of January Anno Domini 1842

Codicil Second

I Nancy Rees, for the purpose of making a further alteration in my foregoing Will, do hereby make this additional Codicil to my will‑ hereby declaring this to be part & parcel of my last Will & Testament ‑ I hereby give in Trust to my Friends Alexander Norris‑ John M. Dargan & Richard Blain an Trustees for my two Grand Sons Scarborough R Drake: and Samuel H Drake-  the foregoing named negroe Slaves & their increase, iihich I have already given to them respectively in the first Codicil to my Will — To have & to Hold the said negro Slaves; for, to, upon, the following uses intents Trusts & purposes & none other- viz-to appropriate the annual profits of said Slaves, towards food & clothing for my two said Grand Sons during their natural lives ‑ & from & after their deaths respectively ‑ then the said negro slaves to be absolutely

the property of their children respectively and should either or both Scarborough R. or Samuel H, die leaving no child or children alive- then the one share or both Shares of said negro Slaves, as the case may be, shall be subject to the same limitations, as are stated in my Will-                      Witnefs my hand & Seal this 11th day of June 1845
