Will of William J Rees

 

State of South Carolina

        

   I, William J Rees of Sumter district in the State aforesaid, Planter, declare this to be my last will and Testament:

   I give and devise my Plantation house and lot, also my Club house tract of land, containing about Three hundred and fifty acres more or lefs, which was given to me by my Father, and also my Taliafero James tract of land containing about Four hundred acres more or lefs, which formerly belonged to my Uncle the late Wm J Rees Sr deceased, together with the appurtenances to the said several premises belonging or in any wise incident or appertaining, unto and to the use of Wilson Waties Rees and E. M. Anderson Esq. and the survivor of them his Executors and Administrators during the life of my Mother, Upon Trust to receive the rents and profits thereof, and pay the same to my said Mother for her sole and seperate use and benefit, free from the debts or control of her husband: And after the decease of my said Mother, To such Uses and upon such Trust, and for such estate or estates, intents and purposes as she, my said Mother, whether covert or sole, by any deed or deeds or other instruments suitable in Law to convey the said property, or by her last will and testament, shall appoint: And in default of such appointment, To the Use of Wilson Waties Rees, his heirs and afsigns forever, And I declare it to be my will that my Mother’s husband shall not be tenant by the Courtesy nor have or enjoy any life estate or other interest in said lands in case he shall survive my said Mother, But the same shall, upon the death of my Mother, without having exercised the power of appointment above given to her, go to Wilson Waties Rees, his heirs and Afsigns forever as aforesaid.

   I give and bequeath all my slaves in South Carolina at the date of this my last will and testament, except such of them as are here in after bequeathed to other persons, together with the future issue and increase of the females thereof to Wilson Waties Rees and E. M. Anderson Esq and the survivor of them his Executors and Administrators In Trust for the same persons, for the sane purposes in the same manner and subject to the same limitations and restrictions as I have already specified in regard to the said several tracts of land above devised.

   I give my watch to my Father, as a testimony of the love I bear him.

   I give and bequeath Hamp and Die his wife together with their children, and the future issue and increase of said Die to my God-daughter Catherine Waties.

   I give and bequeath my slave Ambo to my brother Wilson Waties Rees.

   All the rest, residue and remainder of my Estate whatsoever and wheresoever and of what nature and kind soever, which, at the time of my death, I, or any person or persons in trust for me, am or are possessed of or entitled unto, I give devise and bequeath unto my Brother Wilson Waties Rees his heirs, executors, Administrators and assigns forever .

   I appoint Wilson Waties Rees, Samuel J Bradley, E M Anderson Esq. and F Sumter Esq. Executors of this my last will and testament.

   In Testimony Whereof I have hereunto set my hand and seal this fifth day of October Anno Domini one thousand eight hundred and fifty
