WILL OF JAMES B. RICHARDSON

 


In the name of God Amen.  This the Twenty fifth day of August One thousand  eight hundred and Twenty Six.  I  James Burchill Richardson of the District  of Sumter, & State of So. Carolina, being in perfect strength of the Body, mind and memory, but calling to mind the mortality of man, and that it is appointed for all once to die, Do make, constitute and ordain this my last Will and testament in manner & form following.

First and principally I tender and recommend my immortal soul to God who gave it, steadfastly trusting in his mercy, and the intercefsion of Jesus Christ for everlasting life. And as touching my worldly goods, wherewith it hath pleased God of his infinite goodnefs and mercy to endow me in this life, I do give, bequeath and dispose of in the following manner & form.

Imprimis, To my beloved Wife Ann Cantey Richardson, I give, bequeath and devise the use during her natural life or while she remains my Widow, (in lieu & bar of her right of any Dower of inheritance,) the manor plantation whereon I now reside, containing all the lands from the first ditch in the creek field above the dwelling house, and which I have or shall erect a Stone or pillar, and by a line running thereby Easterly & Westerly from the
Santee River out to my back line just above my present pineland Settlement, all the lands from that line below my lower line on Gum Swamp, adjoining the lands now of John P. Richardson, and one half of Sabba field Tract of  Swamp land on Santee River granted to Benjamin Smith Containing one thousand acres more or lefs; with the use of Dwelling house, the house hold furniture, Plate, & everything on the premises (not otherwise disposed of) thereunto belonging or appertaining, and the use of all the Stock of cattle, Sheep, Hogs mules, and all the implements of husbandry thereon; and the use of all the Negroe Slaves that I leave on the said Plantation at my decease, (and not herein after otherwise disposed of) with all the use & profits of them and their ifsue and increase to her own proper use & behoof.  And my beloved Wife is hereby authorised and empowered at her decease to Will and dispose of one half of the said Negroe Slaves then
there, and one half of their ifsue and increase as She Shall wish or desire to either or all of her children; but in the event that she shall fail or neglect to do so, that half or moiety of the Said Negroe Slaves so devised her, shall be equally divided Share and Share alike between my two sons William H. B. Richardson and Richard C. Richardson or to the Survivor of them at her decease, under the same conditions and restrictions as the respective portions hereinafter given them and the following named Negroe Slaves Viz Mofes my trusty waiting servant, London, Lucy, Eve, Harriett the cook, Elsey, Beck, Fanny, Narina, Bina, Olevia, Driver Jimmy, Molsey, little Harry, Sophy, Patt, Plinny, Rolla, Turkey Mary, Ned carpenter, Hostler Ned, Amelia, Harrington, Phillis Tiscal, Efsex, John Smith, Afhud, Quiz, Tom Glafs, Dollold, Smart, Mudge, old Tilpha, with their future ifsue and increase, shall be a part of the portion of that half or moiety of the
Negroe Slaves intended to be so given her on the manor plantation which she will be authorised & empower'd to Will and dispose of to either or all of my children, and if not so will'd or bequeathed as herein before exprefs'd then to go to my two Sons, as in the preceding part of this clause is prescribed, specified and directed.  Also I give and bequeath to my beloved Wife one of my Carriages and the choice of Five of my carriage Horses, and my purse of Gold containing more or lefs now in her pofsefsion; and all the
Specie money that may be in my house at the time of my decease, to her own use & behoof forever.

Item.  I give bequeath and devise to my beloved Son William H. B. Richardson that plantation or body of Lands from the first Ditch in the Creek field above my House where I have or shall erect a Stone or pillar and by a line running thereby Easterly & Westerly from the Santee River to intersect my back line just above my present Pineland Settlement, all the lands from that line above & to my upper line above half way Swamp,
adjoining lands of the Estate of Johnson, Dubose, and Matthew James, containing Fifteen hundred acres more or lefs; and also one half or moiety of the Sabb's field tract of Swamp land containing one thousand acres more or lefs, granted to Benjamin Smith; also Fifty acres of Land immediately at my Shell landing on Jacks Creek, being out of a tract of land of Four hundred acres grant'd to Samuel Milhouse and to be kept and reserved as a landing for himself & Brother.  Also one moiety or half of my Rocks Plantation bought of Richard Singleton containing one thousand eight hundred & Seventeen acres more or lefs, by a  line running from the main Road acrofs to the Santee River; and also one moiety or half of the Pine land tract or body of land bought of said Richard Singleton containing one thousand Seven hundred acres more or lefs, to be equally divided between
him and his Brother, both the Rocks plantation & the pine land tract, also I give and bequeath to my beloved Son William H. B. Richardson, one lot of Land in Charleston, & one lot in the Town of Columbia, and also the following Negroe Slaves Viz Stumper Jim, Lewis Taylor, Abraham Groom, Whartow, (these are embraced in deed of Gift to him) Dick bricklayer, George carpenter, Robin Carpenter, Prince Carpenter, Lew fifer, Adam,
October Smith, Elsey, Louisa, Augustus, pineland Billy, Tober, Judy, Tenah, Aggy, Dianna, Isabel, Kent Patroon, Sally, Phillis, Leah, Quaccod Susey, Nancy, Guy, Lizzy, Milla, Peggy, Carolina, Bob west, Jefse, Sam Groom, with their future ifsue & increase, with such others to be divided out of my Estate to make the number hereby devised to him one hundred Negroe slaves and I do further Will and direct that if the House I contemplate building, or shall have began to build for my Son William H. B. Richardson on the site designated in the creek field, should not be completed, that the said House shall be builded & completed out of my Estate.  But in case my beloved son William H. B. Richardson should die leaving no child or children, or leaving such child or children, and they should die under the age of Twenty one years, leaving no child or children, then and in that case I Will and bequeath all the lands adjoining or contiguous to my Manor
Plantation that is given to him, And one moiety or half of the Negroe Slaves given him, & such their ifsue & increase, to my beloved Son Richard C. Richardson Should he be then living, or to his eldest male child or children in Succefsion that may Survive a that period, that those lands may always belong to the name.

 

Item.  I give bequeath & devise to my beloved Son Richard C. Richardson at the decease of my beloved wife, or while She remains my widow, the plantation whereon I now live, and all the lands which I have given the use of to my beloved wife during her life, or remains my Widow, from the first ditch in the creek field where I have, or Shall erect a Stone or pillar, & from thence all my lands below, as herein before particularized, containing Fifteen hundred acres more or lefs; also one half of Sabba field Tract of
Swamp land on Santee River containing one thousand acres more or lefs,
granted to Benjamin Smith with the house & furniture, & kitchen implements, plate &c. and everything thereunto belonging, or in any wise incident or appertaining; and all the Cattle, Sheep, & Hogs, and the mules & work horses, waggons & implements of husbandry on the said manor plantation. Also one moiety or half of my Rocks Plantation bought of Richard Singleton containing one thousand eight hundred & Seventeen acres more or lefs, by a line running from the main Road acrofs to the Santee River; and also one moiety or half of the Pine land Tract or body of land bought of Said Richard Singleton containing one thousand Seven hundred acres more or lefs, to be equally divided between him and his Brother, both the Rocks plantation & the pine land Tracts.  Also I give & bequeath to my beloved Son Richard C. Richardson one Lot of land in Charleston, and one Lot in the Town of Columbia, and also the following Negroe Slaves Viz. Befs Edwin, John de Bow, Peter Simms, Peter Downey, Willis, Patsy, Clorentine,
Frederick bricklayer, January Carpenter, Frank carpenter, Paris, Big Grace, Elvird, Phillis, Little June, Androwecha, Orvil, Boat Ben, Romeo, black Rachel pastry cook, Almadia, Dukes, Clarinda, Little Kent, Will, Hampton driver, Hanny, Litty, Peter, Penny, ACR Doll, Little Syb, Isaac pineland, Edmund, with their future ifsue & increase, and other negroe Slaves to be divided out of my Estate when he arrives of age as aforesaid to make his number given him One hundred Negroe Slaves equal to the number given to his
Brother.  But if my beloved Son Richard C. Richardson should die under the age of Twenty one years, or Should survive that age & die leaving no child or children, or leaving such child or children, & they should die under twenty one years, leaving no child or children then and In that case, I Will & bequeath the Manor Plantation, and all the lands adjoining given him, and one moiety or half of all the Negroe Slaves given him, & such their ifsue & increase, & all the Stock of Cattle, Sheep & Hogs, & mules & waggons &c, to my beloved Son William H. B. Richardson should he be then living, and if to his eldest Male child or children in succefsion, that may at that period, that those lands may always belong to the name.  The remaining moiety or half of all the negroe Slaves as devised him, and the moiety or half of the Rocks Plantation and of the Pine land Tract contiguous which I devised him, Should my Son Richard C. Richardson die
under the age of Twenty one years, or arriving of that age Should fail to Will or devise the Same, or leave no child or children, then & in that case I Will & devise that to my Daughter or Daughters that may be then unmarried, & if they should have been all married, then to be equally divided between all my Daughters then living, in the same Manner and conditions of descent as their own portions are respectively devised.

 

Item.  I give bequeath & devise to my beloved Daughter Dorothy S. Mitchell the Belvadere plantation whereon she now resides containing Two hundred acres more or lefs, & for which I have given her a Deed of Gift, to which a plot of the land is annex'd, which is to take effect at my decease, with the conditions therein prescribed, with the Dwelling house & furniture, and all in or thereunto belonging or appertaining.  Also a tract of Swamp land on the North Side of Santee River directly opposite the aforesaid plantation, containing three hundred & fifty acres more or lefs, granted to Anthony Gilmore, & Two hundred acres out of which was granted to me more effectually to secure it.  Also two hundred acres out of my Brush Pond body
of lands, beginning on the upper line on the main Congaree Road & running
three chains off for one chain down the Road, until the complement is obtain'd being part of the Tract of land purchas'd of Charles Sinkler, also the following Negroe Slaves Viz. Mary Seamstrefs, yellow Rachel, Tyrah, Judy, Anna, little Primus, Peter Servant, Belvadere Adam, Dalia, Carolina Belvadere, Hagar, little Mary, Clinton, Sylvester, little Carolina, Driver Simon, Celia, Lydia, Boston, Wallis, Nelly, Amey Kerch, little George,
Isaac Tiger, big Jeny, Little Jeny, with their future ifsue & increase, and such others from off the Belvadere plantation at the time of my decease (not otherwise disposed of), as will make her portion one half of the negroe Slaves that I may then have belonging there, with such of their future ifsue & Increase.  Also a lot of Land laid off or to be laid off for
her, out of my Sand hills body of lands, directly opposite my habitation there, beginning on the main Road on the corner of the Tract of land given Mrs. Florida B. Richardson, in dull creek and running as the main Road does up to my back line (excluding the race course) & as far down the creek as to make one hundred acres, which said Lands & Negroe Slaves I give to her, & at her decease to such child or children as she may have living, & may will or devise the same to; but if she should die leaving no child, or if
such child or children as she should leave, Should die under the age of twenty  one years, or Should arrive to that age and die leaving no child, that then in that case, all the lands & Negroe Slaves so devised (except the Belvadere Plantation as exprefs'd in Deed of Gift) shall revert to my Estate, and be divided among all my children that be then living and I do hereby Will and direct that all the foregoing Estate and property herein
given & devised to my beloved Daughter Dorothy Sinkler Mitchell is exprefsly prohibited from being liable in any wise, manner, or way for any debts or demands on account of acting as Executrix for, or on, her late Husbands Estate.

Item.  I give bequeath and devise to my beloved Daughters Margaret Cantey Spann, and Sarah Jane Cidelia Moore, and Hermione Richardson, and Mary Matilda Richardson, and Anna Julia Richardson to each of them Forty Negroe Slaves.  The thirteen Negroe Slaves already given the use of to my daughter Margaret, & now in her pofsefsion Viz. Hetty, Peter, Jeffy, Arthur, Adair, Judy, Rose, Martha, Mary, Peggy, Mary, Charlotte, Mary as part of her portion of the Forty negroes hereby intended to be given her. And the
Thirty two Negroe Slaves already given the use of to my Daughter Sarah & now in her pofsefsion Viz. Mariah, November, Nelly, Martin, Priscilla, Betty, Simon, Diana, Sibby, Nancy, Adam, Savinia, Daniel, Abby, Harriett, Sam, Ann, Charles, Suwarrow, Plenty, Dembe, Jefse, Dublin, Nero, Nappy, Toney, Annie, Simus, Milly, Dido, Hagar, Florah to be computed as part of her portion of the Forty Negroes hereby intended to be given her.  And the following Negroe Slaves herein given to my Daughter Hermione Viz. Hannah,
Silly, Amey Oliver, Reuben, William, little Rachel, Delia, Tom, (McDuffie her own & not included.) to be computed as part of her portion of the Forty Negroes hereby intended to be given her.  And the following Negroe Slaves herein given to my Daughter Matilda Viz. Phebe, & the girl Eves, to be computed as part of her portion of the Forty Negroes hereby intended to be given her.  And the following Negroe Slaves herein given to my Daughter Julia Viz. Andrew, Allis, to be computed as part of her portion of the Forty Negroes hereby intended to be given her.  Which said Two hundred Negroe Slaves with their future ifsue & increase I will bequeath & devise to my aforesaid five Daughters to them and their child or children respectively; But if either or any of my said five Daughters should die leaving no child or children, or leaving such child or children they should die, & leave no child or children, that then & in that case the portion or
portions of such so dying shall revert to my Estate, & become a part
thereof & shall be divided equally between my children that may be then living, & the heirs & representatives of such as may be deceased, that portion that their parent would be entitled to if then living.  Also I give & bequeath to each of my aforesaid five Daughters a lot or Settlement of one hundred acres of land, out of my Sand Hills, body of land. That to my beloved daughter Margaret, where she has selected & is already settled on, to go from the Mill Creek stream, along my fence (exclusive of any part of
my race course) to my upper line, and the upper line to follow the little branch from the creek to the Source at the little field & from thence to extend to my upper back line, of an oblong form, so to contain the aforesaid number of acres.  That to my beloved Daughter Sarah where she has selected & already is settled on, to go from the Mill creek stream & to run up the branches on each side of the Settlement to their sources, & from thence the lines to go to my back line (exclusive of any part of my race course) of an oblong form, so to contain the aforesaid number of acres. The foregoing two lots or Settlements herein designated I trust I shall be permitted to lay off myself, if not then will be done as aforesaid, & for the others my Executor is enjoin'd to lay wherever Selected (& not otherwise dispos'd of)  upon the same principles as the foregoing.

Item.    I  give  bequeath   &  devise   to  my   beloved Daughters Dorothy S. Mitchell, & Margaret C.Spann,   &  Sarah  J. C. Moore,  &  Hermione Richardson, & Mary Matilda Richardson, & Anna Julia Richardson, each the Sum of Five hundred Dollars to be paid to them respectively by my Executor when he shall find it convenient, out of the unappropriated money in Bank, or from other funds of my Estate to be for their exprefs use & also to purchase for each of them a suit of best mourning, & a mourning Ring for each, with a Suitable device, & for us, present it to them.

Item. I give bequeath & devise to my beloved Daughters Margaret C. Spann, & Sarah J. C. Moore, & Hermione Richardson, & Mary Matilda Richardson, & Anna Julia Richardson, the following Plantations or Tracts of land Viz. the Brush pond plantation in St. John's Berkly, comprising one Tract of Four hundred & eighty two acres more or lefs, one other Tract adjoining bought of Charles Sinkler containing Five hundred & forty three acres more or lefs.  One other Tract adjoining containing Five hundred & eighty four acres more or lefs bought of John Ward.  One other Tract of four hundred &
thirty one acres more or lefs, bought of Benjamin Blackmon.  One other Tract in Sumter District on Santee River below Belvadere adjoining William Sinkler's land, containing Three hundred & thirty three acres bought of Charles Sinkler.  One other Tract adjoining of Three hundred & thirty three acres.  One other Tract of land in the parish of St. James Santee Containing Seven hundred & fifty acres bought of Charles Sinkler. One other
Tract contiguous in parish of St. James Santee containing Seven hundred & fifty acres. Also my Jacks creek plantation, comprising a Tract of Four hundred acres granted to Samuel Milhouse call'd Jacks creek corner (Fifty acres of which at the Shell landing I have before devised).  One other Tract of Two hundred acres adjoining, granted to John Dargan.  One other Tract of Two hundred acres, adjoining, granted to William Dinkins. One
other Tract of Swamp adjoining of Two hundred & fifty acres granted to
William Saunderson.  One other Tract of Swamp contiguous of Three hundred acres granted to Robert Walker, containing in the whole Five thousand two hundred & fifty six acres more or lefs, to be equally divided between them share & share alike. Also three lots & one third of two lots in the Town of Camden, & also two Lots in Statesburgh to be divided between them, or Sold & the proceeds divided as they may deem best & most advantageous for their interest and also with the aforesaid Lands.

Item.  I give & bequeath to my beloved Daughter or Daughters that may remain Single (unmarried) at my decease the Second choice of my carriage, that I May then leave & the choice of a pair of carriage horses (after the choice made by my beloved Wife) & if none shall remain suitable, a pair shall be bought, which shall be exclusively for their use, & in succefsion for those that last remains unmarried,  in like manner I give the Piano or Pianos, & then to become the property of the last one married: & that while they use it (or them) conjointly, to let it be so done with all that harmony & cordiallity that I have so repeatedly witnefs'd with such peculiar joy & delight.  I further will & direct that while any of my Daughters now unmarried shall remain so, that they will live with my
beloved Wife, both at my Home habitation & at my Sand Hills Summer residence, for so long as they may desire it; & to work their Negroes jointly or Separately, & under the directions, care & superintendence of my Executors, or of any person they may desire & the profits & emoluments resulting therefrom to be to their own proper use & behoof.

 

Item.  I give bequeath & devise the use to my beloved wife during her life (or as long as she remains my widow,) my Sand Hills settlement whereon I reside during the Summer with the dwelling house & all the out buildings and appurtenances thereunto belonging with all the household furniture & everything thereunto appertaining and one hundred & fifty acres of land belonging thereto including the race course as it now Stands, and to go
from the Mill creek and to the back of upper line; and at the decease of my beloved wife, I give & bequeath the above seat & and Settlement, (and all as before exprefs'd in the use conveyed) to my beloved Son William H. B. Richardson & his heirs.  But if I should be permitted to live to settle my beloved Son William H. B. Richardson with a Summer residence, then & in that case I herein give & bequeath to him the place whereon he shall be settled and one hundred & fifty acres of land; & give &  bequeath to my beloved son Richard C. Richardson the Summer seat and residence that I have given to my beloved wife the use of during her life or while she remains my widow, and if my Son Richard should die under age of Twenty one years or should survive that age & leave no child or children, or such child or children should die under age of twenty one years, then I give & devise it
to my beloved Son William H. B. Richardson, and if I should not be permitted to live to settle my  beloved son William H. B. Richardson with a Seat on the Sand Hills, then I  give & bequeath to my beloved Son Richard C. Richardson a settlement or lot of land to be laid off for him out of my Sand Hills lands containing one hundred acres from the branch above on the Mill creek to include where the old meeting house now stands, to extend from the Mill creek stream out to my upper line, & in the event of his
decease under the age of twenty one years leaving no child or children it is to go to my Son William H. B. Richardson. And the rest and residue of my Sand Hills lands (not herein before given & devised) I give & bequeath to my beloved Sons William H. B. Richardson and Richard C. Richardson to be equally divided between them, as they may themselves divide it, and in the event of the death of either without leaving any child or children to go to the Survivors.

Item.  I give &  bequeath to my beloved Son William H. B. Richardson my Phaeton and Harness, the choice of my case of Pistols, my Silver Mounted double barrel'd Gun, my Sword, & my breast pin which I highly value & have worn many years.

Item.  I give & bequeath to my beloved son Richard C. Richardson my Book case & Library with all my Manuscripts and papers, and a good double barrell'd Gun Silver mounted, to be purchas'd for him, the other pair of my pistols in the case, & the other pair of silver mounted pistols, my Gold watch & chain &c., my Sleave buttons, and wardrobe of wearing apparel & all thereunto appertaining.

Item.  I give & bequeath to my beloved grand Son William H. B. Richardson Mitchell in addition to what I have given him if he survives his mother the following Negroe Slaves Viz. Hunter & Phillis which I have given him a deed of gift for, & little Prince and Frank, also the double barrel'd Gun, & the pair of Silver mounted pistols that were once his Fathers, also my Mare Poor Girl & her future increase.  But if his mother should not survive him, & he should die under the age of twenty one years or leave no child, then
the portion here given him shall revert to my Estate & go as the residuary part is directed.

Item.  I give & bequeath my Stock of blood Horses in the following manner Viz. To my beloved Son William H. B. Richardson I give my Horses, Virginius, and Seagull, & my mare Transport with her increase & those already given him & in his pofsefsion, as designated in my Stud Book & all their increase.  To my beloved Son Richard C. Richardson I give my horse Sir Archie, the little bay filly out of Transport, the mare Goldfinder & sorrel colt at foot with their future increase.  To my beloved daughter
Dorothy S. Mitchell the pair of grey horses Guilderoy & Mathis & the carriage which she now has, & the brown bay filly out of Poor Girl & her future increase.  To my beloved daughter Margaret C. Spann my half of the mare Pocohontas & the moiety of future increase.  To my beloved daughter Sarah J.C. Moore the sorrel filly out of Lady Jane & her future increase. To my beloved daughter Hermione Richardson the mare Sancardia with her present & future increase & the filly Nancy Air and her increase.  To my
beloved daughter Matilda M. Richardson the sorrel filly from Miss Fortune and Miss Fortune & their increase, &  the brown colt out of Transport.  To my beloved daughter Anna Julia Richardson I give my writing case & all therein, & the mare Lady Jane & her sorrel colt & her future increase.  The rest & residue of my blood horses to be equally divided between my Sons William & Richard.

 

Item.  My Fiscal Plantation composed of three tracts of Land bought of Hubert Rees Shff Sumter District containing one thousand acres more or lefs, & one Tract of Eight acres more or lefs adjoining bought of William Sime, shall be for the use and benefit of my beloved wife during her life or while she remains my widow, & for the use and benefit of my child or children that may live with her, & where a portion of their Negroes may be
work'd for their mutual benefit during that time, with the use also of all the Stock of Cattle, Sheep, Hogs & Mules. And at the Decease of my beloved Wife I give bequeath & devise the said Fiscal Plantation and lands containing one thousand & eight acres more or lefs, with the appurtenances thereunto belonging, and all the Stock of Cattle, Sheep, Hogs & Mules to my beloved sons William H. B. Richardson and Richard C. Richardson or the
Survivor of them of that period, for which they shall jointly pay to each of my other children then living one eighth part of three thousand one hundred Dollars (the original purchase money I paid for it) and if the term proposed herein should be objectionable, then I will & direct that my Executor or Exors shall forthwith sell the said Plantation & lands, & the Stock of Cattle &c, and divide the proceeds thereof among all my children
that may be then living.

Item.  I give & bequeath to my beloved brother Charles Richardson the original portrait of my adored & beloved Father, one of the Portraits of myself, and a Suit of mourning & mourning Ring. And to my beloved friend William Sinkler a suit of mourning & a mourning ring, to be accepted by them in remembrance of my affection for them.

Item.  I give & bequeath to my Nephew James B. Richardson the sum
/////////////////////////////////////////// by my Executors, not for the love that I believe he bears me, but he is the Son of a brother that I very dearly loved, and by him was given the name he bears.

Item.  I Will and direct that out of the money that I have in the Banks, or from monies collected form Specialties, Bonds & Mortgages that I may leave at my decease, the Sum of Twenty Thousand Dollars shall be immediately vested in Bank Stock & the interest arising therefrom, shall so much thereof as shall be necessary, shall be quarterly or half yearly paid by my Executor or Executors into the hands of my beloved Wife to be applied by her for the Education of my two younger children, and my grandson Richardson, and at the decease of my beloved Wife, the interest accrueing as aforesaid or so much thereof as shall be necefsary, shall be so applied by my son William H. B. Richardson, with whom I do then entrust their Education, & I do enjoin & desire that they shall have the very best Education that the United States can afford, & that my sons should study
the science of the Law, & Surveying practically, & if not the former, any other they should most desire; and that during that period, the overplus of interest, if any, Shall be vested from time to time, as it shall so accrue in Bank Stock to increase the Capital, and when their Education is so effected and complete, then I will and direct that the said Capital Stock herein exprefs'd, with whatever increase & augmentation thereof may
accumulate, shall be divided in the following manner Viz. To my beloved Son William H. B. Richardson I give & bequeath one fourth part of the then amount of Bank Stock.  To my beloved Son Richard C. Richardson I give & bequeath one fourth part of the then amount of Bank Stock. And the remaining two fourths or half part I give & bequeath to be equally divided between the rest of my beloved children that may be then living, & the
child or children of such as may be deceased, their parents portion, & also to my beloved Wife if living & remains my widow.

Item.  I give & bequeath to my Executors herein named, that will act on my Estate, the Sum of one thousand Dollars to each, as a Small gratuity, for the great duties that I have herein imposed, & which I pray their acceptance of, & implore their best efforts for the benefit of my belov'd family.

Item.  The rest and Residue of my Estate both Real and Personal or of whatever it may consist at the time of my decease (and not herein otherwise disposed of) I give bequeath & devise in equal portions, share and share alike between my beloved Sons William H. B. Richardson and Richard C. Richardson, and in case either of them should die leaving no child or children the portion of the one so dying shall go to the Survivor.

Item.  It is my wish and desire that my funeral shall be attended with no unusual ceremony, nor  pomp or Show & none to be invited, but welcomely received who may in kindnefs attend it, and that my Body be laid in the refortory provided for it in my family cemetery, and a marble covering to be procured for it, and be borne there from the mansion House by six of my Domestics suitably habited, as I shall direct, and my trusty Servant Mofes Jew to be one.  And at the decease of my beloved Wife I will & devise my
said servant Mofes (who has attended me from early life with much fidelity & devotion to my interest) to my beloved Son William H. B. Richardson, & request that he be provided with a Suit of mourning, & that he be kindly treated by them & be indulged in any little privilege that will add to his comfort & happinefs.

Item.  I do further Will and direct that this my last Will and Testament shall be taken & construed in its liberal & literal sense & meaning, & the division & distribution of the respective portions be made accordingly; and I do enjoin it upon my beloved wife, and each of my beloved children & my Executors to fulfill the same in the most cordial and affectionate manner, & in order to preserve this conduct more affectually, as I have endeavoured through life to do the best I could for them, & in this last act I have herein manifested it, bearing them all the tenderest love and affection ; I do therefore enjoin on them in the most solemn manner, my warmest entreaty & request, that they will always live in friendly union and cordiallity with each other; that thus united in mutual and kind reciprocation of good offices, that will from an insufferable and irresistible barrier againstthe prefsure of external exegences, & the innovations of the world on their peace and prosperity; & for which I trust in the mercies of my God for its lasting preservation.

Lastly.  I do hereby nominate, constitute & appoint my beloved wife Ann C. Richardson (while my widow) executrix & Guardian to my minor children, and my beloved son William H. B. Richardson &
_________________ Executors of this my last Will & Testament utterly revoking, disavowing & disallowing all other Will or Wills, Testament or Testaments, heretofore by me made, and acknowledging, publishing, pronouncing and declaring this and no other to be my last Will and Testament, contained on these Twenty pages of paper & each with my name sign'd thereon, and to be taken & construed in the liberal and literal sense and meaning.  In Witnefs whereof I have hereunto set my Hand & afix'd my Seal, the day and year first above written.
