Will of MARY GOLDLIGHTLYRUTLEDGE

 

The State of South Carolina

 

I Mary Golightly Rutledge of SumterDistrict and State aforesaid do make and ordain this my last Will andTestament-

I give to my brother Francis K. Huger andto my excellent and esteamed friend and relative Alfred Huger, inTrust, for the use of my daughter Maria H. Waties during her naturallife, the following Slaves, (viz) Mary Ann, Chlo, Hagar, Tenah (theCook)

Nancy and Hardy: also all my Plate and householdfurniture: Also thirteen thousand Dollars ($13,000) to be laid out ongood Security, yielding an annual interest, which interest shall bepaid to my said daughter Mariah H. and she shall be permitted tohave and enjoy the hire or use of the said slaves, Plate andFurniture, and her receipt shall be a sufficient discharge: And fromand after the death of my Said daughter Maria H. in Trust for theChildren she may have living to be equally divided between them: Andif any of her Children shall die in her life time having issue suchissue shall represent the parent - but in case she shall depart thislife without leaving issue at the time of her death, then in Trust,for such person or persons, such use or uses as she shall by will orotherwise direct: And it is my meaning and intention that theprovision here made for my daughter Maria shall be a full dischargefor the legacy of a slave left her by her great grandmother Mrs. MaryAgrue-

I give to thw Said Francis K. Huger andAlfred Huger in Trust, for the use of my daughter Ann Sarah Rutledgeduring her natural life the following Slaves (viz), Hercules, Hannah,and Matty, also thirteen thousand Dollars ($13,000) to be investedand laid out on good Security, yielding an annual interest, which,which interest shall be paid over to my said daughter Ann Sarah: andshe shall be permitted to have the use of the Slaves allotted for herbenefit, And her receipts shall be a sufficient discharge. And mysaid daughter Ann Sarah shall have the right to dispose by Will orotherwise (in the event of her having no issue) of the last mentionedslaves and the last mentioned thirteen thousand Dolars: But in Caseshe shall marry, then it is my will that both the slaves and moneygiven to her use shall be held by the said Trustees for the benefitof such child or children as she may have to be equally divided amongthem: And it is my meaning and intention that the provision hereinmade for my said daughter Ann Sarah shall be taken as a fulldischarge for the legacy of a slave left her by her great grandmotherMrs. Mary Agrue-

My residence Called Sans Souci and all theland connected with it I give to my two daughters Maria H. and AnnSarah with the liberty of disposing of it at pleasure - I give to mythree grand children Mary, John and Thomas Waties a Bond of JohnTucker Esquire given for the sum of Eight hundred Dollars, - theinterest as it accrues to be re-invested until the said Childrenseverally arrive at age -

To my grand Son Benjamin H. Rutledge Igive a negro Slave called Daphne, the mother of Godfrey: I make nofurther provision for my Said grandson Benjamin not that I have lessaffection for him than my other grand Children, but because he isalready more amply provided for than they are - In sead of apecuniary bequsst he has the assurance of my most affectionate andlasting regard. To my son Francis H. Rutledge I give five thousandDollars ($5,000) and to my son John H. Rutledge, I give the like sumof five thousand Dollars ($5,000). The provision here made for mysaid two Sons Francis H. and John H. is intended to be a fuldischarge of a legacy of a slave to each of them left by their greartgrandmother Mrs. Mary Agrue -

I wish George and Chlo two aged Slaves topass the residue of their days on the Plantation of Mrs. BenjaminHuger provided her permission can be obtained -

Lastly I appoint my daughter Maria H.Waties and my son Francis H. Rutledge Executrix and Executor of thismy Will and Testament. In testimony whereof I hereunto set my handand Seal this 14th day of February Anno Domini Eighteen hundred andthirty five.
