Will of William Smith

In the name of God, Amen. I, William Smith,living in the above named place and being very sick and weak but ofperfect mind and memory thanks be to God, and calling to mind thatall men must die I have thought proper to make this my last Will andTestament.

 

I commend my Soul to Almighty God who gave itand my Body to be buried in a Christian like and decentmanner.

 

Item, My will and desire is that all my lawfuldebts be paid.

 

Item, I give and bequeath unto my well belovedwife, Jane, the Plantation whereon I now live during her natural lifeand at her death to be the property of my daughter, Rebecca McElveen. Also three Negroes namely a fellow named Hope, wench named Binah andher daughter Pheby with two beds and furniture, also, her choice ofhorses that shall then be in my possession, also, my riding chair andsaddle and bridle, also, my dining table and celerett.

 

Item, I give and bequeath unto my son, WilliamH. Smith, all my lands lying in Williamsburg District consisting offour tracks, also, three Negroes namely old Jacob, Harriot and Lizzy,also, one bed and furniture in full of all my real and personalEstate.

 

Item, I give and bequeath unto my daughter,Martha Kennedy, the Plantation and track of land that I purchasedfrom Elijah Johnston, Jr. to her and her issue forever.

 

Item, I give and bequeath unto my son, Henry F.Smith, all my lands lying North of a line running from the lowercorner of the Lowry Tract and East to the District line.

 

Item, My will and desire is that all the rest ofmy personal property be equally divided between my wife, Jane, mydaughter, Rebecca McElveen, my daughter, Martha Kennedy, and my son,Henry I. Smith. And, I do hereby appoint my well beloved wife,William McElveen, and my son, Henry I. Smith, Executors to this mylast Will and Testament disannulling all others.

 

In witness whereof I have hereunto set my handand seal this thirteenth day of February in the year of our Lord onethousand eight hundred and thirty and in the fifty fourth year ofAmerican Independance.
