Will of RICHARD SPANN

 

The State of South Carolina--

 

I Richard Spann of the District of Sumter andState aforesaid, being old an infirm in body, but of Sound anddisposing memory & mind, do make and constitute this last willand testament-

1st I give and bequeath unto the Heirs of my SonRobert fifteen Hundred Dollars in cash

(to be collected from notes due me) to be equallydivided among them, share and share alike--

2nd I lend to my son Charles during his naturallife and after his death I bequeath unto his children the followingnegroes viz, Mary and her two children, Leonora and Eliza, which saidnegroes I have valued at fourteen Hundred & fiftyDollars--

3rd I give and bequeath unto my Son Harry a negrowoman named Sill (sp) and her three youngest children, Tom &Lydia, said negroes I have valued at fifteen Hundred and fifty eightDollars--

4th I give an bequeath unto my grand daughterRebecca Ann Spann, now Rebecca Ann Collins (the daughter of my sonFederic, deceased) the following negroes Nancy and her two childrenGranola and Mary, the said negroes I have valued at twelve Hundredand Seventy five Dollars--

5th I lend to my daughter Martha during hernatural life a negro woman named Mahaly and her three childrenJackson, Elizabeth and Harriet, and at the death of my said daughterMartha, I give and bequeath the above named negroes to her childrenforever, the said lot of negroes I have valued at Eighteen Hundredand twenty five Dollars--

6th I give to my son Henry in trust for thebenefit of my Daughter Sarah during her natural life (after the deathof my wife) and at the death of my daughter Sarah to her childrenforever, the tract of land on which I now live called the LinebackersTract containing two Hundred acres more of less, share and sharealike--

7th The balance of my property consisting of myland not heretofore given, Stock of Hogs, Cattle, Horses, Householdand Kitchen furniture, Plantation tools, and nine Negroes viz,Daniel, Buck, Stauling, Ned, Jinny, Caroline, Mahaly, Mack and Lewis,and their future increase, I give to my beloved wife during hernatural life, and at her death it is my desire that the above namedlegacy to her be equally divided among the following Heirs viz, Myson Henry and the children of My son Charles and the children of mydaughter Martha , and the children of my daughter Sarah, equallyShare and Share alike, so that the children of Charles and thechildren of Martha and the children of Sarah draw an equal share withmy Son Henry (To wit) one fourth to the children of each of the abovenamed in this clause, and one fourth to my Son Henry, and it is myfurther desire that my Son Henry, may have the privilege of taking inthe Said division the following negroes viz, Lewis, Mack, Caroline,and Mahaly and the future issue of Caroline he paying over to theother Heirs above named in this clause the over plus if any, so thateach of the Heirs claiming under this clause Shall have an equalShare of this residuary legacy--

8th I wish the property allotted and that may fallto the children of my Son Charles and to the children of my daughterMartha, and to the children of my daughter Sarah, not to be subjectto the disposal of my Son Charles or my daughter Martha or mydaughter Sarah, or liable for their debts, but kept in trust fortheir lawful issue, and I do hereby appoint my Son Henry Trustee tothe Said trusts respectively--

9th I do further declare that it is my sish thatshould either of my children above named die leaving no lawful issuein that case, the property allotted and that may fall to them of myEstate shall return to the Survivors mentioned above, or the theirdescendants--

10th I hereby nominate and appoint my son HenrySpann and my friend Henry D. Green Executors to this my last will andtestament--

 

In witness whereof I have hereunto Set my hand andSeal this 8th day of Jany 1842.
