Will of

Joseph Sprott

In the name of God Amen I Joseph Sprott ofClarendon County, Sumter District, in the State of South

Carolina, being of sound disposing mind memory andunderstanding, yet being feeble in body, do,

considering the uncertainty of human life, makethis my last will and Testament as follows. That is to say,

I desire that my body shall be buried at thedirection of my executors hereafter nam'd, and I direct that all

my just debts may be paid out of my Estate, assoon as is convenient: and as to the Estate which it has

pleased God to favor me with, I do hereby give,devise and bequeath, in manner and form as follows.

First I hereby revoke any and all former willsmade by me; and I desire at my death, that all my bonds,

notes, securities and other uncollected debts dueme may be collected as soon as possible, by my Executors

hereafter named, and when collected to be in thehands of my Executors as assets for the payment of debts

and of legacies

Second I desire also that all my plantation tools,Hogs, Horses and other Stock, may be sold on a credit of

twelve months and the proceeds to be applied by myExecutors hereafter nam'd for the payment of debts

and legacies

Third. I give, devise and bequeath, unto my nephewJoseph Sprott son of my brother Hugh Sprott of North

Carolina all my lands, except Three hundred acres,call'd the Wise tract, and all my Negroes of which at

my death I die possed, to him and his lawfulheirs, of his body begotten; but in case the said Joseph Sprott

shall die leaving no lawful and living issue thenthe said lands and Negroes to pass in remainder unto my

Brother Hugh Sprott and his children share andshare alike to them and their heirs forever: and I charge upon

my said property thus conveyed, the decent supportand maintenance of my faithful servant Bob, desiring,

and making it a charge upon my said Estate herebyconvey'd, and a condition of this clause of my last Will

and Testament that my Nephew Joseph Sprott shallcomfortably maintain him during his own live, and

should the said Servant Bob outlive my said NephewJoseph Sprott he shall be supported by the Issue of the

said Joseph Sprott or by Hugh Sprott and hischildren to whom the said lands and Negroes may descend,

the said parties aforesaid not being Empower'd tosell the said servant Bob, and being hereby directed out

of the said Estate hereby convey'd in addition tohis maintenance, to pay taxes and to exert all other acts of

ownership over the said Bob, Saving and exceptingthat they shall allow him the free use and benefit of his

time and labor and all acquisition the result ofthis honest industry

Fourth I give devise and bequeath unto my NephewThomas Sprott of North Carolina Three hundred Acres

of land, or that tract of land call'd the Wisetract, containing about three hundred acres, though not to be

poss'd of it or go into possession of, until afterthe death of old Free Molly Pearson who is to have the

privilege of living on, and cultivating said tractof land during her natural life free of rent, my Nephew

Joseph Sprott paying the taxes of the same up tothe time of the said Molly Pearsons death

Fifth, I give devise and bequeath to my BrothersHenry Sprott and Moses Sprott and my Sister Sarah Sprott

of the Parish Dromere County of Ireland Twothousand dollars to be equally divided between them, their

Heirs Administrators and Assigns

Sixth The rest residue and remainder of my EstateI give devise and bequeath unto my Brother Hugh Sprott

and his children (with the exception of JosephSprott) to be equally divided share all and share alike to

them their heirs Executors Administrators andassigns

Seventh I desire, that the legacies in the twopreceding clauses of this my last will and testament viz (Fifth

and Sixth) shall be paid by my Executors out ofthe funds in their hands from the collection of the Bonds,

Notes, securities and debts referred to in thefirst clause of this my will, and from the sale of the plantation

utensils and stock referred to in the Secondclause

Eighth Out of the rest, residue and remainder ofmy Estate refer'd to in the sixth article, I will and bequeath

unto my Nephew Thomas Sprott one feather bed andits furniture and all the balance of my household and

Kitchen furniture I will and bequeath unto mynephew Joseph Sprott as also all my provision crop that may

be in the house or in the field at mydecease.

Ninth I appoint as my Executors to this my lastwill and Testament my esteem'd friends Harvey Skinner

and William Lewis

Sign'd sealed published and declared by me thesaid Joseph Sprott this the twenty fourth day of April in the

year of our Lord One thousand Eight hundred andforty Six as the last will and testament of my the said

Joseph Sprott, and in token thereof I hereunto setmy hand and seal
