Will of Henry Young

 

The Last Will and Testament of Henry Young

 

Item. It is my desire that my executorshereinafter named, out of the sales of my present crop, pay andsatisfy all my just debts.

 

Item. I give, devise and bequeath to my wifeAbigail Young for and during the term of her natural life thefollowing real and personal estate. To wit; That part of theplantation or tract of land on which I now reside, lying below theStatesburgh road. And the following negroes, To wit, Amy and hernine children, Beckey and seven of her children names as follows:Hester, Joseph, Martha, Betsey, Prince, Stephen and Francis; and mytwo negro men Sawney and Isham making twenty in all, also all myhousehold and kitchen furniture, Five head of horses, Twenty head ofcattle, my carriage and riding chair and one waggon.

 

And from and immediately after the death of mywife I give devise and bequeath the above named personal estate(which I have bequeathed to her during her natural life) to mydaughter Holly Kennedy, her Heirs, executors, administrators orafsigns absolutely and forever, and my real estate, so much of

the same to my Grandson William G. Kennedy as willmake it equal in value to the real estate hereinafter bequeathed tomy grandson Francis H. Kennedy, absolutely and forever; and theresidue

of the real estate remaining (after taking outsuch part for my Grandson William G. Kennedy) bequeathed to my wifeduring her natural life, to my daughter Holly Kennedy her heirsexecutors administrators and afsigns absolutely and forever.

 

Item. I give devise and bequeath to my daughterHolly Kennedy for and during the term of her natural life thefollowing real and personal estate, To wit, The remaining part of theplantation or tract of land on which I now reside, lying above theStatesburgh road which will include my mill; And the followingnegroes as named, making twenty three, To wit Jefsey, Minda, Pompy,Neppy, Anderson, George, Tommy, Benjamin, Anny, Bristow, Isaih,Prince, Chloe, Little Jefsey, Cornelius, Little Minda, Richard,Grandson, Skillen, Lucy, Henry, Coachman and Juno, Also five head ofhorses, one waggon and the residue of my stock herein beforebequeathed to my wife; And from and immediately after the death of mydaughter Holly Kennedy I give devise and bequeath the above namedreal and personal estate which I have bequeathed her during hernatural life to her Heirs executors administrators and afsingsabsolutely and forever.

 

Item. I give devise and bequeath to my grandsonFrancis H. Kennedy, his heirs executors administrators and afsigns myHorse pen plantation or Tract of land together with eight negroes out

of my estate.

 

Item. I give devise and bequeath to my grandsonWilliam G. Kennedy, his heirs executors administrators and afsigns,eight negroes out of my estate.

 

Item. I give devise and bequeath to my grandDaughter Sarah M. Ervin, wife of William E. Ervin for and during theterm of her natural life a Negro Girl named Amelia and seven othernegroes out of my estate; And from and immediately after the death ofmy Grand Daughter Sarah M. Ervin, I give devise and bequeath the saideight negroes together with their increase into such child orchildren as may survive her at her decease share and share alike, Butin case my Grand Daughter Sarah M. Ervin should die without leavingchild or children surviving her, then and in that case, I give deviseand bequeath the one half of the said eight negroes and theirincrease to her Husband William E. Ervin,

his heirs executors administrators or afsigns, andthe remaining half to be equally divided among my then survivingGrandchildren, share and share alike.

 

Item. I give devise and bequeath to each of myremaining grand Daughters Abigal Y. Kennedy, Eliza H. Kennedy andAnna Adella Kennedy the following personal property in way and mannerherein more particularly defined.

 

To my Grand Daughter Abigal Y. Kennedy a NegroGirl Rina and seven other negroes out of my estate and during theterm of her natural life.

 

To my Grand Daughter Eliza H. Kennedy a Negro GirlMaria and seven other negroes out of my estate for and during theterm of her natural life.

 

To my Grand Daughter Anna Adella Kennedy a NegroGirl Holly and seven other negroes out of my estate for and duringthe term of her natural life.

 

Should either of my last mentioned Grand DaughtersAbigal Y. Kennedy, Eliza H. Kennedy and Anna A. Kennedy marry and dieleaving child or children of such marriage surviving them, then andin that case I give devise and bequeath unto such surviving child orchildren the negroes and their increase bequeathed to their motherduring the term of her natural life, absolutely and forever. But incase either of my Grand Daughters Abigal Y. Kennedy, Eliza H. Kennedyand Anna A. Kennedy die without leaving such child or childrensurviving them; then and in that case I give bequeath and devise theNegroes and their increase given to such grand Daughters during hernatural life over to my surviving Grand child or Grand children thenliving, share and share alike absolutely and forever.

 

Item. I give my Watch to Henry Y. Kennedy, son ofWilliam M. Kennedy.

 

Item. I give devise and bequeath to William M.Kennedy Two thousand Dollars which I charge as a debt upon my estateand which I wish paid over to him by my executors hereinafter namedas soon as can be conveniently raised out of my estate.

 

All the rest and residue of my property real andpersonal not herein specifically bequeathed I give to my Son in lawFrancis L. Kennedy absolutely and forever.

 

Lastly I nominate constitute and appoint my son inlaw Francis L. Kennedy, William E. Ervin and my Grandson Francis H.Kennedy Executors of this my last will and Testament hereby revokingall others heretofore made. My executors in apportioning the negroesnot named over to my Grandchildren will have them all appraised andgive to each their respective numbers, regard being had to the equalvalue of each share.

 

In testimony whereof I have hereunto set my handand affixed my seal this first day of October Anno Domini Onethousand eight hundred and thirty four.

 

Signed Sealed published and declared the last willand testament of Henry Young in the presence of us who in thepresence of each other and in the presence of the testator haveaffixed our names as witnefses to the due execution hereof.

Codicil to Will of Henry Young

 

The following bequest having been omitted, at thesigning of this my last will and Testament, I hereby annex the samein the presence of the Witnefses to my will as above. I give deviseand bequeath to my Nephew William Young a negro Boy named Mosesabsolutely and forever.

 

In testimony whereof I have hereunto set my handand affixed my seal this first day of October One thousand eight andthirty four.
