Will Book 23, pg.710, Brunswick County, Virginia
I T.W. Clary, of the county of Brunswick, state of Virginia, being of sound
mind, but feeble health, do make this my last will and testament, to wit:
1. I direct that all my debts be paid if there be any.
2. I give, bequeath, and devise unto my beloved wife, Hattie B. Clary in fee
simple all the personal property that I may die possessed or that I may heir
anytime in the future, with full power to sell or dispose of in any way that in
her judgment may seem best; I also give my said wife the farm on which we live
and say other real estate I may heir any time in the future all to be used
during her life with full power to rent or handle in any way she deems best in
providing a support for herself and our three small children, Leanard, Wilton &
Selena.
3. I direct that my real estate shall be held by my said wife during her life,
and should she die before our youngest child becomes twenty one years old, I
direct that the said real estate be used for the benefit of the younger children
until all become of age and then I direct tat all the real estate be sold and
proceeds equally divided among my lawful heirs. 4. It is not my desire to
discriminate or show any partiality toward any of my children, but knowing, that
the older children are able to provide for themselves, it is my desire to make
the best provision I can for my wife and small children, whom I know will need
all the help I can give them.
5. I appoint my said wife, Hattie B. Clary, guardian during their respective
minorities, of such of my children as, at the time of my death, shall be
required of her as such guardian; and I also appoint my said wife executrix of
my said estate, and that no security be required of her and no appraisement or
inventory be made of any of my personal property. Signed as and for my will this
29th day of December 1917.

In clerk's office Brunswick Circuit court, Mar. 26, 1923.
A writing purporting to be the last will and testament of
T.W. Clary deceased , was produced in said office and proved by the oaths of
A.S. Rawlings and H.E. Valentine the subscribing witnesses thereto and ordered
to be recorded as the true last will and testament of T. W. Clary, deceased. And
on the motion of Hattie B. Clary the executrix therein named who made oath
thereto according to law, (the will directing no security to be required of her)
entered into and acknowledged a bond in the penalty of $1000.00 conditioned as
the law directs. Certificate is granted Hattie B. Clary for obtaining a probate
of said will in due form.
