Last Will and Testament of James Harwell

IN THE NAME OF GOD AMEN I James Harwell leave unto my eldest Son Grief Harwell the following four Tracts of Land Vizt. the first consisting of one hundred and fifty Acres lying on Coxe's Creek and which I Bought of John Robertson, The second Tract consists of six hundred Acres lying in Mecklenburg County, The third Tract consists of four hundred Acres which I purchased of Daniel Carroll upon which last tract the said Carroll is to live during his lifetime.  The fourth tract consists of one hundred acres which I purchased of John Lambert and which joyn's the above mentioned Tract Bought of the above Daniel Carroll, The above said four mentioned tracts of land whether they consist of a greater of (sic) less numbers of Acres then is herein mentioned, I give and bequeath unto my Son Grief Harwell to him and his Heirs forever.  Item I give and bequeath unto my second Son James Harwell the tract of land I now Live on consisting of five hundred and fifty Acres be it more or less to him and his Heirs forever.  Item I give and bequeath unto my eldest Daughter Anna to  her and her heirs forever two negroes Vizt Bob, a boy and Linda a wench with all her future Increase Item I give and bequeath unto my second Daughter Mourning to her and her heirs forever two negroes Viz. Anthony a Boy and Nelly? a Girl with all her future Increase Item I give and bequeath unto my third daughter Elizabeth to her and her heirs for ever two Negros Viz. Godfrey a Boy and Phibb a Girl with all future Increase Item I give and bequeath unto my fourth Daughter Sally to her and her Heirs for ever two negroes Viz. Will a Boy and Daphny a Girl with all her future Increase.

Item I give and bequeath unto my fifth Daughter Caseander to her and her Heirs for ever two Negroes Viz. James a fellow and Younger a Girle with all her future Increase.  Item I give and bequeath unto my eldest Son Grief to him and his Heirs foreever two Negro fellows Nash? and Lewis Likewise Sally? a wench with all her future increase Item I give and bequeath unto my second Son James to him and his Heirs forever two Negro Boys Stafford and Peter, Likewise Haney? a wench with all her future Increase Item, my intent is that all my Children and my Children's Negro's shall live together on this Plantation on this tract of land whereon I now live and which I have given to my second Son James, that is to say, they shall live here till the said James comes of Age, And likewise that Jordan Mabry, Son of Joshua Mabry shall live along with my Children and shall make [   ] on this plantation as he thinks most proper, and that the said Crops and whatever Increase comes from the said Plantation with the help of my two Sons and all my Children's Negroes shall be equally divided amongst all my Children and the said Jordan Mabry, I likewise desire that all the Plantation expenses Taxes likewsie the expenses of Cloathing and maintaining the said Children and their negroe's shall be deducted out of every years Crops before the division of the same Crop.  I further desire that the above said Jordan Mabry shall retain as much out of my Stock and Household furniture as he shall think Necessary for the maintenance of him and my Children likewise for [   ] this plantation and making of Crops, And I desire that when all my [  ] children are of Age that all my household furniture shall be Sold and not til then, And that as well as the Stock and plantation utensils shall be all at that time devided equally amongst my Children and Jordan Mabry, and further desire that --

the remainder of my Negros not already mentioned in this my Will shall be at my death publickly Sold as well as all my other  personal estate as is not now mentioned in my will and is not kept by the said Jordan Mabry for the above said use, And the money arising from the Sales thereof shall be equally divided among all my Children when they come of Age I likewise desire that all my Just debts and funerall charges shall be paid out of the above Money before the aforesaid division, Item I do make constitute and appoint Jordan Mabry and Peter Thomas my whole and Sole Executors of this my last Will and Testmanet IN WITNESS of this and the two preceding pages I have to each of them set my hand and Seal this eighth day of September in the year of our Lord one thousand seven hudnred and seventy.

At a Court held for Brunswick County the 25th day of February 1771.  This Will was presented in Court by Peter Thomas the surviving Executor therein named proved by the Oath of Thomas Craufurd one of the Witnesses thereto and Ordered to be Recorded And the said Executor personally in Court refusing to take upon himself the burthen of the Execution thereof On the Motion of Samuel Harwell who made Oath thereto according to law and together with Thomas Stith and Thomas Simmons his Securities entered into and acknowledged a Bond in the penalty of five thousand pounds with conditions as the law directs Certificate is granted him for obtaining Letters of Administration of the said decedant's estate (with the Will annexed) in due form.
