This Indenture made this seventh day of November, in the year of Our Lord one thousand eight hundred and thirty five Between James Bays and Ruth his wife, of Washington County and state of Virginia, Joel Bays and Betsey his wife, of Scott County and State of Virginia, Peter Bays Jr. and Peggy his wife of Russell County and State aforesaid, Andrew R. Martin and Mary his wife of Russell County and State of Virginia, and Harrington Little and Susannah his wife of Washington County and Commonwealth of Virginia of the one part, - and John Bays senior of Russell County and State aforesaid of the other part -. Witnesseth that the said James Bays and Ruth his wife, Joel Bays and Betsey his wife, Peter Bays junior and Peggy his wife, Andrew R. Martin and Mary his wife, and Harrington Little and Susannah his wife, for and in consideration of One hundred dollars lawful money of Virginia to each of them in hand paid (that is, to each man & his wife paid) by the said John Bays senior at or before the sealing and of these presents, the receipt whereof is hereby acknowledged Have granted, bargained, and sold, and do by these presents grant, bargain, and sell unto the said John Bays senior all the estate, right, title, interest, property claim, and demand whatsoever which is one eighth each of Peter Bay's estate on land in the Loop which the said James Bays and Ruth his wife, Joel Bays and Betsey his wife, Peter Bays junior and Peggy his wife, Andrew R. Martin and Mary his wife, and Harrington Little and Susannah his wife now have, or hereafter shall have, either in law or equity, in the lands and tenements of which their father Peter Bays senior dec'd ______? and possessed, or to which the said Peter Bays senior had a legal or equitable title and the reversion, or reversions, remainder or remainders thereof lying in the County of Russell with the appurtenances thereunto belonging. To have and to hold all the interest aforesaid of them the said James Bays and Ruth his wife, Joel Bays and Betsey his wife, Peter Bays junior and Peggy his wife, Andrew R. Martin and Mary his wife, and Harrington Little and Susannah his wife to him the said John Bays senior his heirs and assigns forever and the said James Bays and Ruth his wife, Joel Bays and Betsey his wife, Peter Bays junior and Peggy his wife, Andrew R. Martin and Mary his wife, and Harrington Little and Susannah his wife for themselves and their heirs do covenant and agree to, and with the said John Bays senior his heirs and assigns that they the said James Bays and Ruth his wife, Joel Bays and Betsey his wife, Peter Bays junior and Peggy his wife, Andrew R. Martin and Mary his wife, and Harrington Little and Susannah his wife all their interest as aforesaid in the lands, and tenements as aforesaid with their appurtenances to him the said John Bays senior his heirs and assigns against the claims of all persons whomsoever, shall and will warrant and forever defend.

In witness whereof the said James Bays and Ruth his wife, Joel Bays and Betsey his wife, Peter Bays junior and Peggy his wife, Andrew R. Martin and Mary his wife, and Harrington Little and Susannah his wife, have hereunto set their hands and seals this day and year first above written.

Russell County to wit

We William Price and George W. Johnson justices of the Peace in the County aforesaid in the State of Virginia do hereby certify that James Bays, Peter Bays, Andrew R. Martin, and Harrington Little, parties to a certain deed, which is above written, personally appeared before us in our County aforesaid, and acknowledged the same to be their act and deed and desired us to certify the said acknowledgment to the Clerk of the County Court of Russell in order that the said deed be recorded. Given under our hands and seals this second day of January, 1836.

Russell County to wit

We William Price and George W. Johnson justices of the Peace in the County of Russell in the State of Virginia, do hereby certify that Ruth Bays the wife of James Bays, Mary Martin the wife of Andrew R. Martin and Susannah Little the wife of Harrington Little parties to a certain deed bearing date the seventh day of November in the year of our Lord 1835, unto which this certificate is annexed personally appeared before us in our County aforesaid and being examined by us privately and apart from their husbands, and having the deed aforesaid fully explained to them, they the said Ruth Bays, Mary Martin and Susannah Little, acknowledged the same to be their act and deed, and declared that they had willingly signed, sealed and delivered the same, and that they wished not to retract it. Given under our hands and seals this second day of January, 1836.

This Indenture of bargain and sale from James Bays and others heirs of Peter Bays deceased to John Bays was acknowledged before me in the Clerk's Office of Russell County on the 21st day of May 1836 by Joel Bays a party thereto, and together with the certificate of its acknowledgment by the other parties, before Justices of the peace as the law directs, being personally filed in said office with such certificates on the 2d of April, 1836 was admitted to record.
